KRISHNA MURARI, C.J. (Oral)

The petitioner-Society was allotted route No.4 of District Hisar to operate from Hisar to Singhawa. The petitioner-Society was originally allotted route No.4 of Hisar on its own request. Thereafter, on the request of the petitioner-Society, it was provisionally allotted route No.11 of District Jind from Narwana to Padarth Khera via Kharal, against additional vacant permit in lieu of route No.4 of District Hisar. Subsequently, since it was found that though Government has sanctioned an additional permit on this route, but the same has not been notified in the official Gazattee, only one permit can be deemed to have been sanctioned for this route and, accordingly, the provisional permission granted to the petitioner-Society to operate on route No.11 was cancelled and it was directed to resume its operation on route No.4 of District Hisar, which was originally allotted to the Society.

1 of 2 ::: Downloaded on - 14-07-2019 07:33:49 ::: CWP No.11975 of 2000 2 Learned Senior counsel for the petitioner states that in view of the facts and circumstances, since the petitioner has been permitted to operate on route No.4, the challenge to cancellation of the additional permit has lost its efficacy due to efflux of time.

The petition accordingly stands disposed of.
