None appeared for the applicant in this case. Therefore, looking to the absence of applicant's counsel and as the matter is an old one pending since 2015, we heard the counsel for the respondents and reserved the matter by exercising our powers conferred under Rule 15(1) of the CAT (Procedure) Rules, 1987.
2. The brief facts of the case is that the respondent No.1 issued an advertisement dated 15.10.2014 for the post of Employee & Welfare Inspector having a pay scale of Rs.9300-34800/- and grade pay of Rs.4200/- for the employees of the railways. The applicants were having the requisite qualification and had applied for the above mentioned post and after scrutiny they were found eligible and the names were shown in the list of eligible candidates. Vide letter dated 15.04.2015 the respondents refused to allow the applicants to appear in the said Page 2 of 5 3 O.A. No. 200/00620/2015 examination on the ground that they are not eligible to appear in this exam being RPF personnel.

The respondents have filed their reply wherein it has been submitted that notification dated 15.10.2014 (Annexure A/1) was issued for the post of SWI pay band-II 9300-34800 GP-4200/- but the copy of the same was not sent to CSC (RPF) because the employees working in RPF department are not eligible to appear in this selection as per Railway Board's RBE No.139/2003. The provisional eligibility list for the selection of SWI was issued vide letter dated 05-03-2015 but after examination of the eligibility of the candidates a list of eligible candidates was issued by this office vide letter dated 10-07-2015 Digitally signed by RAJUL RAJU NAMDEO DN: C=IN, O=Personal, PostalCode=482004, L=Jabalpur, S=Madhya Pradesh, STREET="

They will also not be eligible to appear in other Departmental selections in Departments other than RPF/RPSF.
5. We have heard learned counsels for the parties at length and examined the pleadings and the documents annexed therewith.
6. The question for consideration before us is whether RPF personnel should be considered for or excluded from departmental selection/promotion on railways. In regard to the eligibility of RPFs Page 3 of 5 4 O.A. No. 200/00620/2015 personnel for various selections / promotions in the Railway Establishment per se, the Railway Board has stipulated that the RPF / RPSF personnel cannot be allowed to appear in General Departmental Competitive Examination [GDCE), as also other departmental selections conducted by the department other than RPF / RPSF. These instructions have issued in terms of letter dated 11.8.2003 (RBE 139/2003), which reads thus:- R.B.E. No. 139/2003

Date: 2026.02.13 10:15:08+05'30' the scheme of GDCE has been introduced with the main Foxit PDF Reader Version: 2024.3.0 objective of facilitating redeployment of surplus staff either by redeployment of such staff in the posts vacated by staff selected under GDCE or surplus eligible staff themselves getting selected under the scheme. However, the selection of RPF/RPSF staff under the GDCE cannot in any way facilitate redeployment of surplus staff. In view of this and on the analogy of practice begin followed by the Central Police Forces (CPFs) under the control of the Ministry of Home Affairs as also the very nature of job and the method of recruitment in RPF/RPSF, it has been decided that the RPF/RPSF Personnel cannot be allowed to appear in the GDCE. They will also not be eligible to appear in other Departmental selections in Departments other than RPF/RPSF. However, the past cases decided otherwise will not be reopened.Page 4 of 5 5 O.A. 6.1 Subsequently, The CAT Principal Bench New Delhi's vide its judgment dated 30.12.2003 in O.A. No. 2661 of 2003 has upheld the Railway Board's RBE No. 139/2003 wherein it is clearly mentioned that "it has been decided that the RPF/RPSF Personnel cannot be allowed to appear in the GDCE. They will also not be eligible to appear in other Departmental Selections in Departments other than RPF/RPSF.
7. Thus, in view of the observations made here-in-above, we do not find any ground to interfere with the selection process. Accordingly, the present Original Application is hereby dismissed. No order as to costs.
