Section 226(3) in Assam Municipal Act, 1956

(3)If the owner, occupier or farmer of a market makes default as aforesaid, the Board may enter into possession of the market and execute such improvement mentioned in subsection (1) as it deems fit, and may receive all rents, tolls and other dues in respect of the market and retain possession thereof for recovery of the sum expended by it on the works of improvement:Provided that the Board shall vacate the market if it appears that the sum expended by it on the works of improvement has been realized; and that the surplus, if any, remaining after the payment of the expenses incurred shall be paid on demand to any person who establishes his right to the satisfaction of the Board or in a court of competent jurisdiction.Sale of Food
