Section 141(1) in The Bihar Motor Vehicles Rules, 1992
(1)No person shall use and no person shall cause or allow to be used or to be in any public place any motor vehicle which does not comply with the rules contained in this chapter, or with the rules made by the Central Government under Chapter-VI I of the Act or with any order made thereunder by a competent authority:Provided that any officer of the Motor Vehicles Department of and above the rank of an Assistant Motor Vehicle Inspector may not permit the use of a motor vehicle with defective brakes or lights, if in the opinion of such officer, the use of such defective vehicle constitutes the danger to the public, until the defect is remedied.
