Section 25(2) in Securities and Exchange Board of India (Employees' Service) Regulations, 2001
(2)On confirmation in the higher grade, the pay of an (2) employee shall be fixed at the stage in the higher grade which is next above his substantive pay in the old scale as on the date of confirmation, if such pay be higher than the pay drawn by him at the time of confirmation.
