Mr. Bari, learned advocate for the petitioner has
submitted that the case is a peculiar one. Here the
private respondent taking lien in the school namely, Sri
Guru Vidyamandir High School (HS), joined as Headmistress of Birpara Girls' High School (HS), she joined Birpara Girls' High School in December, 2020. The recommendation letter is dated 22.12.2020 is at page 32 (annexure - P-5) of the writ application. Now she wants to be transferred in Sri Guru Vidyamandir High School (HS) and as Headmistress and recommendation for transfer has been made by the West Bengal Central 2 School Service Commission as Headmistress of Birpara Girls' High School (HS) which is at page 30 (Annexure P-
3) of the writ application.
This matter was mentioned before me on the ground of urgency by learned advocate Mr. Bari as his client apprehends that the private respondent, being respondent no. 12, has sufficient clout in different levels of the society whereby she can come and join this school namely, Sri Guru Vidyamandir High School (HS) forthwith which would be an illegality.
Considering such urgency, I directed Mr. Bari to serve a copy upon Dr. Patra who usually appears for the West Bengal Central School Service Commission and to come after serving copy at 3.30 P.M. today and the matter would be taken up as a matter in the supplementary list and in this way the matter is taken up.
Dr. Patra naturally has received the copy today and submitted that he has to take certain instruction.
The matter will appear in the list on 16th December, 2021 and in the meantime there shall be stay of limited period on the recommendation of the School Service Commission dated 29.10.2021 transferring the respondent no. 12 from Birpara Girls' High School (HS) to Sri Guru Vidyamandir High School (HS) till 23rd December, 2021.

I direct the petitioner to serve a copy upon all the necessary respondents except Dr. Patra upon whom service has already been made.
List this matter on 16th December, 2021.
