And In the matter of:- Rafik Sk. & Ors.

                                             petitioners

         Ms. Minoti Gomes,
Md. Hafiz Ali for the petitioners

Mr. Jayanta Banerjee for the State

The petitioners, apprehending arrest in connection with Salar P.S. Case No. 260/14 dated 8.8.14 under Sections 147/148/149/307/407 of the Indian Penal Code and Sections 3/ 4 E.S. Act have come to this court for anticipatory bail. Heard the learned counsel appearing on behalf of the parties. Perused the case diary.

The claim of the learned counsel for the petitioners that the petitioners are standing on the same footing with other co-accused persons, who were granted anticipatory bail by this court has not been disputed from the side of the State.

We have also gone through the case diary and find no reason to take a different stand.

Having regard to above, the prayer for anticipatory bail is allowed on parity.

In the event of arrest, the petitioners shall be released on bail to the satisfaction of the Arresting Officer upon furnishing 2 a Bond of Rs. 5,000/- each on condition that after release the petitioners shall surrender before the regular court within four weeks thereafter.

This order is subject to the conditions as laid down in sub- section (2) of Section 438 of the Code of Criminal Procedure.

The application for anticipatory bail is, thus, disposed of.
