Petitioners, who are working as Constables in the Haryana Police, seek quashing of the letter dated 17.01.2017 (Annexure P-13) vide which juniors to the petitioners, i.e., private-respondents No.6 & 7 have been deputed in Intermediate School Course, ignoring the claim of the petitioners. It is also their case that private-respondents No.5 to 7 have already been deputed and respondent No.5 has also been promoted and that the petitioners have been arbitrarily ignored.

Counsel could not point out from the writ petition that the respondents have been approached for the necessary relief. It is settled principle that a writ of mandamus can only be issued if the respondents have been approached, at the first instance and if there is any denial on account of the respondents in acting upon the said requests which may be on the basis of some legal rights.

In such circumstances, counsel does not press the present writ petition and prays for liberty to approach the respondents, for the necessary relief.

Ordered accordingly.
