                     -------------------------------
Dated this the 3rd day of November, 2020

                              ORDER

This Crl.M.C is filed for issuing a direction to the IVth Additional Sessions Judge, Thrissur to reschedule trial in S.C. No. 1396/2008 to the month of January 2021. The counsel submitted that because of the pandemic situation, the counsel for the accused and the accused are not able to appear before the court and the case is listed for trial to 5.11.2020 only on 23.10.2020. There is no time for the counsel concerned even to study the matter.

2. The Public Prosecutor submitted that this is one of the oldest case pending before the sessions court and there is a direction from this Court to dispose of the sessions case. The counsel for the petitioner submitted that an application is 4 Crl.M.C. No. 4909 of 2020 already filed by the accused to extend the time for the final disposal of the case.

' I don't want to consider the above contentions of the petitioner or the Public Prosecutor. If there is any grievance to the petitioners regarding the scheduling of this sessions case, the petitioners can approach the trial court with an application narrating all the difficulties. If such an application is filed before the lower court, the learned Sessions Judge will consider the same and pass appropriate orders before starting trial.
