FACTS
This matter is called for hearing today dated 3.1.2013. The parties have not appeared before the Commission. Hence, the matter is being decided on the basis of material on record.
2. It is noticed that vide RTI application dated 20.1.2012, the appellant had sought certified copies of the complete file notings of File No. 4 (27)/ 2007/D/QA.
3. Vide letter dated nil, Under Secretary, MoD, had informed the appellant that the appellant's request for promotion to Assistant Foreman was examined in a different file and report in regard thereto was sent to the Chief Justice of Orissa High Court and, therefore, he could seek copy of file notings from DGQA Establishment.
4. The result is that neither MoD nor DGQA appears to have provided any information to the appellant. The proper course of action for MoD would have been to transfer the RTI application to DGQA u/s 6 (3) of the RTI Act thereby obligating DGQA to respond to it but this was not done leading to the present litigation. Be that as it may, the CPIO of the Ministry of Defence is hereby directed to transfer the RTI application to DGQA u/s 6 (3) of the RTI Act even now for an appropriate action at his end.
5. The matter is being closed at the Commission's end.
