Section 5 in The Sick Industrial Companies (Special Provisions) Act, 1985
5. Constitution of Appellate Authority .-(1) The Central Government may, by notification, constitute, with effect from such date as may be specified therein, an Appellate Authority to be called the "Appellate Authority for Industrial and Financial Reconstruction" consisting of a Chairman and not more than three other Members, to be appointed by that Government, for hearing appeals against the orders of the Board under this Act.
(2)The Chairman shall be a person who is or has been a Judge of the Supreme Court or who is or has been a Judge of a High Court for not less than five years.(3)A Member of the Appellate Authority shall be a person who is or has been a Judge of a High Court or who is or has been an officer not below the rank of a Secretary to the Government of India or who is or has been a Member of the Board for not less than three years.
