.-In these rules, unless the context otherwise requires,-(i)"Act" means the Mines and Minerals [(Development and Regulation)] [ Substituted by G.S.R. 56(E), dated 17.1.2000 (w.e.f. 18.1.2000).] Act, 1957 (67 of 1957);(ii)"Form" means a form set out in Schedule I to these rules;(iia)[ "illegal mining" means any reconnaissance or prospecting or mining operation undertaken by any person or a company in any area without holding a reconnaissance permit or a prospecting licence or, as the case may be, a mining lease, as required under sub-section (1) if section 4 if the Act. [Inserted by Notification No. G.S.R. 593 (E) dated 26.7.2012 (w.e.f. 11.11.1960)]Explanation. - For the purpose of this clause, -(a)violation of any rules, other than the rules made under section 23C of the Act, within the mining lease area by a holder of a mining lease shall not include illegal mining;(b)any area granted under a reconnaissance permit or a prospecting licence or a mining lease, as the case may be, shall be considered as an area held with lawful authority by the holder of such permit or licence or a lease, while determining the extent of illegal mining.](iii)"railway" and "railway administration" have the meanings respectively assigned to them in the Indian Railways Act, 1890 (9 of 1890);(iv)"Schedule" means a Schedule appended to these rules;(v)"section" means a section of the Act.
