The State of West Bengal & Ors.
Mr. Santosh Kumar Chakraborti
Mr. Swapan Kumar Mitra
... For the petitioner.
Mr. Goutam Mukherjee
...For the respondent no. 2.
Ms. Sanghamitra Nandi Ms. Manika Pandit ... For the State.
Having heard the learned advocates for the parties and upon perusing the instant writ petition, it appears that
- in the facts and circumstances of the instant case - there is no need for this Court to exercise its jurisdiction to interfere with the order dated 7th March, 2013, passed by the Mission Director, Paschim Banga Rajya Sishu Siksha Mission. The said order appears to have been passed in compliance with this Court's earlier order dated 4th February, 2013, passed in W. P. 423 (W) of 2011.
The impugned order is supported with cogent reasons and is in conformity with the direction, as contained in the order dated 4th February, 2013.
In such circumstances, the writ petition is liable to be dismissed and is accordingly dismissed.
Urgent photostat certified copy of this order, if applied for, be given to the learned advocates for the parties.
(Biswanath Somadder, J.) Xerox plain copy of this order duly countersigned by the Assistant Registrar (Court) be given to the learned counsel for the parties on usual undertakings.
Referring to the affidavit of service, it is submitted that steps for service of notice as well as copy of the application have already been taken.
Since no affidavit in opposition has been filed the allegations/averments made in the application are deemed not to have been admitted.
