Shri Aaditya Adhikari, learned Senior counsel with Shri S. C.
Chaturvedi, learned counsel for the respondent.

In rejoinder filed by the petitioner in paragraph 12 it is stated-

“12- That, the petitioner further submits that earlier the officers have rightly rejected the condidature of respondent No.4 as he was offered the land jointly owned by Matadeen Yadav and Matadeen Dubey. After purchase of share of Mata deen Yadav the respondent No.4 became co-owner with Matadeen Dubey. On the date of application respondent No.4 was the owner of 1/4 th share only and according to that share he was having 125 Ft frontage only against the requirement of 150 Ft. The respondent No.4 with a view to fulfil the frontage of 150 Ft has attached consent letter of Matadeen Dubey and in the case of consent of co-owner he should have been awarded 25 marks in the head of land, whereas, he has been wrongly given 35 marks. A dispute was also pending on the date of application raised by the co-owners which was also suppressed by the respondent No.4, therefore, he was rightly declared ineligible during the course of investigation.”

- however no cogent material is brought on record to substantiate the contentions in paragraph 12 of the rejoinder. Learned counsel for the petition prays for a short adjournment to file additional documents to substantiate his submission in paragraph 12 of the rejoinder.

Interim order to continue till next date of listing.
