02/16.12.2021 Heard learned counsel for the applicant and learned A.P.P. for
the State.
Learned counsel for the applicant undertakes to remove the defects, as pointed out by the office within a period of one week.
This bail application has been filed on behalf of the applicant- Sunil Saw @ Sunil Kumar Saw with prayer to release on bail in connection with Narayanpur P.S. Case No.177 of 2020 registered under Section 379 of the Indian Penal Code pending in the court of learned Sub-Divisional Judicial Magistrate, Jamtara.
Learned counsel for the applicant has submitted that the F.I.R. of this case was lodged by the informant with the allegations of theft of copper coils from the power transformer worth Rs.3,70,000/- against the unknown thieves. The name of the applicant surfaced during investigation when the applicant was apprehended in other case crime and he confessed his guilt. Nothing incriminating article has been recovered from the possession of the applicant. The alleged confession has no evidentiary value in the eyes of law. The applicant has been languishing in jail since 28th July, 2021.
Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant.
In view of the submissions made and material on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.15,000/-(Rupees Fifteen Thousand) with two sureties of the like amount to the satisfaction of the court of learned Sub-Divisional Judicial Magistrate, Jamtara in aforesaid case.
