1. For the reasons stated in the application, the delay of 490 days in filing the application for recalling of order dated 20th December, 2024 is condoned.
2. Accordingly, the application is disposed of.

3. This application has been filed by Major Amanpreet Singh, son of Late Major Singh (the victim/patient), through his Power of Attorney Holder and brother, Dilbagh Singh, seeking recall of order dated 20th December, 2024 passed in the present writ petition filed by Dr. Birinder Pal Singh Bajwa. By the said order, this Court had directed that the operation of order dated 30th September, 2024 passed by the Ethics and Medical Registration This is a digitally signed order.

4. The Applicant principally contends that the aforesaid order came to be passed without affording him an opportunity of hearing. It is, however, pertinent to note that the order dated 20th December, 2024 was passed only to ensure that the statutory remedy availed by Dr. Birinder Pal Singh Bajwa was not rendered infructuous during the pendency of the appeal before the Appellate Authority. The Court had expressly clarified in paragraph 5 of the said order that it had not examined the merits of the controversy and that all rights and contentions of the parties were expressly kept open.

Be that as it may, the order dated 20th December, 2024 has since worked itself out as the Appellate Authority/ National Medical Commission has already adjudicated the statutory appeal preferred by Dr. Birinder Pal Singh Bajwa vide order dated 25th September, 2025. The said appellate order was thereafter assailed by Dr. Birinder Pal Singh Bajwa in W.P.(C) 19569/2025 before this Court. However, the said petition came to be withdrawn in view of the objection raised on behalf of Respondent No. 1 regarding territorial jurisdiction.
6. In light of the foregoing, no further direction is required to be passed in the present application and the same is disposed of.
