Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 272, 273, 290, 414, 420, 188, 428, 429, 34 of the Indian Penal Code, Section 3/4 of the Animal Cruelty Act and Section 15 of the Environment Protection Act.

3. The allegation in the FIR is that several slaughter houses were being run in the State of Bihar after flouting the norms of Central Pollution Control Board. It has also been alleged that from the place of occurrence, some processed meat was recovered from one container bearing Registration No. NL-01AF0886.

Learned counsel for the petitioner submits that there is general and omnibus allegations levelled in the FIR against several slaughter houses and so far as the present vehicle in question is concerned, the only allegation against the petitioner is that he is the driver of the said vehicle. It is further submitted that the petitioner has no concern either with the slaughter house or the seized meat. It is also submitted that the owner of the said vehicle has been granted the privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 31.01.2024 passed in Cr. Misc. No. 1466/2024 (Annexure-3).

Considering the facts and circumstances of the case and particularly the fact that the owner of the said vehicle has been extended the privilege of anticipatory bail, I am inclined to grant the privilege of anticipatory bail to the petitioner who has no criminal antecedent. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Patna High Court CR. MISC. No.66584 of 2024(4) dt.15-05-2025 3/3 Magadh University P.S. Case No. 219 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ 482 (2) of the BNSS, 2023.
