1. The issues under consideration arising out of the second appeal dated 01.08.2019 include non-receipt of the following information raised by the appellant through the RTI application dated 28.03.2019 and first appeal dated 08.05.2019:-

(i) "वतमान म बक के ारा संचािलत/ ािधकृ त whatsapp group व facebook क सूिच पूण िववरण (group/facebook का नाम व Admin का नाम व पद) क जानकारी दान करने क कृ पा कर! Page 1 of 5

(ii) बक तर से Whatsapp group/facebook/instagram/ व twitter के प म चहाने हेतु टाफ को दी गयी मा यता/अनुमित क सूिच दान करने क कृ पा कर, साथ ही Admin का नाम भी देने क कृ पा कर!

(iii) वतमान म बक टाफ ारा कतने Whatsapp/facebook/instagram व twitter चलाये जा रहे ह, एवं स बंिधत इन whatsapp/facebook etc. पर post message को बक तर से कस िनयमो व कन या के तहत जांच क जाती है, अनुरोध है जांच के िलए िनयु अिधकारी का नाम व पद क जानकारी भी दी जाये!

(iv) Social Media App को बक म कस service regulator व sub regulation म उ लेख कया गया है, सा य सिहत जानकारी देने क कृ पा कर!

(v) बक ारा बोड से अनुमो दत social media policy क ित दान करने क कृ पा कर"

Succinctly facts of the case are that the appellant filed an application dated 28.03.2019 under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Baroda Uttar Pradesh Gramin Bank, Bareilly, seeking aforesaid information. The CPIO vide letter dated 26.04.2019 replied to the appellant. Dissatisfied with the same, the appellant filed first appeal dated 08.05.2019. The First Appellate Authority (FAA) vide order dated 10.06.2019 disposed of the first appeal. Aggrieved bythe same, the appellant filed a second appeal dated 01.08.2019 before the Commission which is under consideration.

3. The appellant has filed the instant appeal dated 01.08.2019 inter alia on the grounds that reply given by the CPIO was not satisfactory. The appellant requested the Commission to direct the CPIO to provide the complete information and take necessary action as per Section 20 (1) of the RTI Act.

4. The CPIO replied vide letter dated 26.04.2019 and the same is reproduced as under:-

(i) "स बंिधत सूिच हमारे कायालय म तैयार नह क जाती है! (Admin का नाम स बंिधत हा स एप ुप पर वतः देखा जा सकता है!

(ii) उभयप ी स देश (Bilateral Communication) हेतु सामियक मह व के िवषय एवं बक वसाय से स बंिधत सुझाव हेतु कु छ हा स एप ुप एवं े ीय कायालयवार शाखा मुख हेतु हा स एप ुप काय कर रहे ह!

(iii) Whatsapp/Facebook/Instagram/Twitter ुप स ब धी सं या हमारे कायालय म तैयार नह क जाती है! बक ारा समय समय पर का मको को सोशल मीिडया (यथा फे सबुक, हा स एप आ द) के उपयोग क सलाह दी जाती है!

(iv) स बंिधत प रप क ित संल क जा रही है!

(v) स बंिधत प रप क ित संल क जा रही है!"

The FAA vide order dated 10.06.2019 directed the CPIO to provide information to the appellant within 03 weeks of receipt of FAA's order. After compliance of FAA's order, the CPIO vide letter dated 28.06.2019 provided the following information:

(i) "Whatsapp group क उपल ध सूिच जो हमारे पास है, पूण िववरण सिहत संल है! (Admin का पद हा स एप ुप म उि लिखत नह है, अतः दान कर पाना संभव नह है!) Facebook/ Instagram/Twitter स ब धी सुचना हमारे बक म पहले से समे कत/तैयार नह है एवं न ही बक के दशा िनदश के अंतगत तैयार करने क ज है! उभयप ी स देश (Bilateral Communication) हेतु सामियक मह व के िवषय एवं बक वसाय से स बंिधत सुझाव हेतु कु छ हा स एप ुप एवं े ीय कायालयवार शाखा मुख हेतु हा स एप ुप काय कर रहे ह!

(iii) Facebook/Instagram/Twitter स ब धी सूचना हमारे बक म पहले से समे कत तैयार नह है एवं न ही बक के दशा िनदश के अंतगत तैयार करने क ज रत है! य द कोई कसी भी social media पर य द कोई अपमानजनक/असंभदीय message post करता है तो स म ािधकारी के सं ान म लाने के उपरा त उसक जांच बक िनयमानुसार क जाती है!

(iv) बड़ोदा उ र देश ामीण बक, अिधकारी और कमचारी सेवा िविनयम - 2010 के िविनयम 21 से स बंिधत है! उ िविनयम क ित संल है! Page 3 of 5

(v) बक ारा बोड से कोई भी social media policy अनुमो दत नह है! हालां क बक ारा समय समय पर का मको को सोशल मीिडया के उपयोग क सलाह दी जाती है व स बंिधत प रप भी जारी कये जाते है!"

5. The appellant and on behalf of the respondent Shri Rajesh Gupta, Chief Manager, Baroda Uttar Pradesh Gramin Bank, Bareilly, attended the hearing through audio conference.

5.1. The appellant inter alia submitted that he had received the information and was no longer willing to pursue the second appeal.

5.2. The respondent while defending their case inter alia submitted that in compliance of the FAA's order dated 10.06.2019 they had provided complete information to the appellant on 28.06.2019.

6. The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of records, observed that due reply was given by the CPIO on 28.06.2019. Moreover, the appellant during the course of hearing submitted that he was satisfied with the information furnished to him and expressed his willingness to withdraw his second appeal. That being so, there appears to be no public interest in further prolonging the matter. Accordingly, the appeal is dismissed as withdrawn.

Copy of the decision be provided free of cost to the parties.
