(1)Subject to the provisions of Article 311 of the Constitution of India the [ - ] [Words 'Presiding Lokpal and Up' omitted vide Act No. 1 of 1998.] Lokpals may be removed from their respective offices by the Governor on the ground of misbehaviour or incapacity and on no other ground "Provided that the inquiry required to be held under clause (2) of the said Article before such removal shall only be held by a person appointed by the Governor being a person who is or has been a Judge of the Supreme Court or a Chief Justice or Judge of the High court.
