JUDGMENT
1. Vide this judgment, the present petition filed by petitioners namely Dr. Rohini Sakhuja and Ms. Madhu Narang for grant of succession certificate in their favour qua the debt and securities in the name of Late Sh. Ravi Narang with the bank/company concerned in the form of balance credits, shall be disposed of.
2. In the petition, it is inter-alia pleaded that Late Sh. Ravi Narang, who passed away intestate on 28.12.2020, was the Succ Court 101/21 Rohini Sakhuja Vs. State & Ors Page No. 5 of 42 brother of petitioners. It has been further pleaded that at the time of his death, the deceased was ordinarily residing at Defence Colony, which falls within the territorial jurisdiction of this Court. It has been further pleaded that deceased had not married during his lifetime and therefore, the petitioners, being his sisters are his only Class-II, item (2) legal heirs. It has been further pleaded that the petitioners and the deceased had aunt ( "mausi") namely Ms. Sarla Bala Nagpal @ Ms. Sarla Nagpal, who had also not married during her lifetime and she had bequeathed the amounts lying in her accounts in favour of deceased Late Sh. Ravi Narang vide a registered Will dated 21.09.1984. It has been further pleaded that accordingly, succession certificate has been sought in the present matter with respect to debts and securities of Late Ms. Sarla Bala Nagpal also which had devolved upon the deceased Late Sh. Ravi Nagpal vide the said Will.

The record of the Court file reflects that the general notice of this petition was given to public by way of publication in the newspapers "Veer Arjun" on 06.12.2021 and "The Statesman" on 06.12.2021. In response to the said notice, no person from the general public came forward to offer any objection(s) qua grant of succession certificate to the petitioner.
4. During the summary proceedings conducted as per Section 373 of the Indian Succession Act, 1925, 29 witnesses were examined.
5. Through her testimony, PW-1 Dr. Rohini Sakhuja tendered Succ Court 101/21 Rohini Sakhuja Vs. State & Ors Page No. 6 of 42 her evidence by way of affidavit Ex.PW-1/A and she relied upon the following documents:
i. Copy of the Special Power of Attorney executed by Ms. Madhu Narang, Ex.PW1/1 (OSR).
ii. Copy of the death certificate, Ex.PW1/2 (OSR) iii. Copy of the Legal heir certificate, Ex.PW1/3 (OSR) iv. Copy of death certificate of Ms. Sarla Nagpal, Ex.PW1/4. v. Ms. Sarla Nagpal had executed a duly registered Will dated 02.09.1984, Mark PW1/5.

She further deposed that Ms. Sarla Nagpal and Sarla Bala Nagpal are one and the same person.
34. The entire record as well as the testimonies of the witnesses have been perused. Valuation report alongwith submissions in writing had been filed on behalf of the petitioners. It has been Succ Court 101/21 Rohini Sakhuja Vs. State & Ors Page No. 24 of 42 stated in the written submissions that the petitioners are not claiming succession certificate with respect to the debts and securities which, as per reports furnished by banks and companies concerned, have already been transferred in favour of the petitioners.
35. Perusal of legal heir certificate Ex.PW1/3 (OSR) shows that Dr. Rohini Sakhuja (petitioner no.1, sister) and Ms. Madhu Narang (petitioner no. 2, sister ) are the only surviving Class II legal heirs of the deceased. Further, there is no impediment to issuance of succession certificate in favour of petitioners and also, no one came forward to oppose issuance of succession certificate despite publication in newspapers.
36. Therefore, in view of legal heir report and above discussion, it is hereby ordered that succession certificate be issued in favour of petitioners namely Dr. Rohini Sakhuja and Ms. Madhu Narang for ½ share each qua the debts and securities in name of Late Sh. Ravi Narang and Late Ms. Sarla Nagpal @ Sarla Bala Nagpal which are as follows:
