In view of the condition that was imposed earlier while passing the orders on parole petition filed by Bhura and Nandu co-accused when the other co-accused shall be released only after Nandu @ Nandkishore surrenders before the jail authorities after completing the period of parole. This fact clearly finds mention in the order dated 26.3.2012 passed in D.B. Civil Writ Petition (Parole) No.2680/2012, Bhura @ Premraj S/o Shri Bharatlal Meena v/s The State of Rajasthan & Ors which has been annexed as Annesxure 2. It has been submitted that Nandu who had been granted parole by this court who is co-accused, has not surrendered before the jail authorities after he was granted parole vide order dated 26.3.2012 and Bhura @ Premraj, co-accused has already been released on parole. The learned counsel for petitioner therefore, submits that he may be permitted to withdraw this petition and he would file the same after the co-accused Nandu either surrenders or he is apprehended.
The petition is accordingly permitted to be withdrawn with liberty to file a fresh petition after Nandu surrenders or is apprehended.
