Dutta ..for the State The instant writ petition has been filed in the year 2011 by a handicapped person who has been recommended for appointment as Assistant Teacher in Palita High School in the District of Birbhum under the handicapped quota. It has been submitted by the petitioner that the medical certificate on which reliance has been placed by him was never objected. However, the case of the petitioner was referred to SSKM Hospital for Audiometry examination but the hospital authorities have not submitted the report as yet and as such the petitioner's appointment was kept in abeyance till day. When the case was listed in March, 2016, this Hon'ble Court has directed for hearing peremptorily but today when it was called on, a request has been made on behalf of the counsel for the School Service Commission that the matter may be adjourned. However, for the ends of justice and equity, the matter is adjourned.
List this matter in the next week to enable the counsel for the School Service Commission to seek instructions as to why and what steps has been taken by the School Service Commission with regard to the report, if not furnished by the said hospital.
