Aggrieved against the order passed by the learned Single Judge in the writ petition, where direction had been issued for decision of the representation filed by the appellants, present appeal has been preferred raising a grievance that restriction of arrears to 38 months from the date of filing of writ petition should not have been imposed.

While referring to the directions issued by the learned Single Bench of this court on 21.1.2010, while disposing of CWP No. 9294 of 1993--Thana Singh and others v. The Punjab State Electricity Board and another, where all similarly situated employees were directed to be paid the benefits and further the observations by Hon'ble the Supreme Court in IA No. 6-9/2013 in Petition(s) for Special Leave to Appeal (Civil) No (s) 1 of 2 ::: Downloaded on - 26-01-2018 10:51:20 ::: LPA No. 47 of 2018 [2] 35109-35112 of 2012--Punjab State Power Corp. Ltd. v. Rajesh Kumar Jindal and others, decided on 2.8.2013, which was Special Leave Petition against the order dated 23.2.2012, passed in LPA No. 264 of 2012--Punjab State Power Corporation Limited, Patiala v. Rajesh Kumar Jindal and others, which was disposed of in terms of the judgment of Thana Singh's case (supra), learned counsel for the appellants submitted that he may be permitted to withdraw the writ petition itself to avail of appropriate remedy in terms of the observations made by Hon'ble the Supreme Court.

Ordered accordingly.

The appeal stands disposed of.
