                                  ORDER

1. The complainant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Oil & Natural Gas Corporation Limited, Ankleshewar, seeking information on six points, including, inter-alia:-

(i) Certified copies of his PAR percentage for the years 2011, 2012, 2013, 2014, 2015 and 2016;
(ii) Certified copies of his Composite Social Security Scheme statements for the year 2011, 2012, 2013, 2014, 2015 and 2016;
(iii) Certified copies of my Pay slips for all months for the years 2013, 2014, 2015, 2016, etc.

2. Being aggrieved with the response given by the respondent, the complainant filed a complaint u/Section 18 of the RTI Act before the Commission requesting to take appropriate legal action against the CPIO u/Section 20 of the RTI Act.

Hearing:

3. The complainant attended the hearing through audio-call. The respondent, Shri Umesh Y Raul, CPIO along with Shri V K Mehta from WELL Services and Shri Vijay Patel from Finance department attended the hearing through audio- call.

4. The complainant submitted their written submissions dated 06.02.2021 and 11.02.2021 and the same has been taken on record. The respondent submitted their written submissions dated 03.02.2021 and the same has been taken on record.

5. The complainant submitted that complete and correct information has not been provided to him by the respondent on point nos. 3.5 and 3.6 of his RTI application dated 23.02.2019. The complainant stated that copies of complete pay-slips has not been provided to him by the respondent.

The respondent reiterated the reply given by the CPIO and FAA and submitted that point-wise reply/information as per the documents available on record has been provided to the complainant within stipulated period of time as per the provisions of the RTI Act. The respondent further stated that some pay- slips has not been generated, therefore, not provided to the complainant.

Decision:

7. The Commission, after hearing the submissions of both the parties and after perusal of records, observes that the prayer of the complainant in his complaint is to provide him complete and correct information. The complainant stated that he wants to file second appeal but it was filed as complaint. In view of this, the complaint should be treated as second appeal.

8. The Commission observed that the respondent contested that complete information as per the documents available on record has been provided to the complainant. On the other hand, the complainant was aggrieved that complete certified copies of pay-slips has not been provided to him and the certified copy of absentee statement has also not been provided to him. The respondent further contested that the pay-slips which are generated has been provided to the complainant. In view of this, the Commission directs the respondent to search the information as sought by the complainant on point no. 3.6 of the RTI application and provide to the complainant and if no such information is held by the respondent public authority in material form then a categorical reply in this regard should be given to the complainant, within a period of 15 days from the date of receipt of this order.

9. With the above observations, the complaint is disposed of.
