In these batch of writ petitions, the petitioners have questioned the legality and validity of the circular dated 12.3.2007 by which it has been held that Assistant Teacher/Upper Division Teacher, who have completed their B.Ed. decree/B.T.I. training on government expenses, they will not be entitled for two advance increments from 23.10.1964 to 01.03.99 and only the teachers who have passed the said examination on their own expenses, they will be entitled for said two advance increments.

Mr.Ajay Shrivastava, Mr.B.L.Dembra and Mr.Rahul Mishra, learned counsel appearing for their respective petitioners, would submit that such discrimination on the basis of passing of B.Ed. decree/B.T.I. training is impermissible in law as all the teachers are similarly situated and they are governed by same set of rules. Merely on the ground that the petitioners have passed their B.Ed. decree/B.T.I. training on government expenses, they cannot be held disentitle for 13 the aforesaid benefit. They relied upon the judgment of the Supreme Court in the matter of Food Corporation of India and others v.

Ashis Kumar Ganguly and others1.

3. Mr.Y.S. Thakur, learned Deputy Advocate General appearing for the respondents/State, would submit that since the petitioners have done their B.Ed. decree/B.T.I. training on government expenses i.e. reasonable classification, they are not disentitled for the benefit of two advance increments. He would further submit that Government is ready and willing to consider the representations of the petitioners in accordance with law.

4. I have heard learned counsel appearing for the parties, and given thoughtful consideration to the submissions raised therein and also gone through the record with utmost circumspection.

5. A bare perusal of the impugned circular would show that the teachers, who have passed their B.Ed. decree/B.T.I. training on their own expenses, they will be entitled for two advance increments.

In the matter of Food Corporation of India and others (supra), Their Lordships of the Supreme Court have held that granting of benefit to one set of employees and denying it to other set of employees, when both sets were governed by same rules/orders is discriminatory and violative of Article 14.

7. In the matter of Y.K.Mehta and others v. Union of India and another2, Their Lordships of the Supreme Court have held that when 1(2009) 7 SCC 724 2 1988 (Supp) SCC 750 14 posts in two wings of the same government department are identical and involve same nature of duties, denial of parity in pay would be violative of Articles 14, 16 and 30(d) and observed as under:-

"11. We have gone through the averments in the writ peti- tions and those made in the counter-affidavits filed by the Director General of Doordarshan and we have no hesita- tion in holding that the petitioners perform the same du- ties as those performed by their counterparts in the Film Division. When two posts under two different wings of the same Ministry are not only identical, but also involve the performance of the same nature of duties, it will be unrea- sonable and unjust to discriminate between the two, in the matter of pay. One of the directive principles of State Pol- icy, as embodied in clause (d) of Article 39 of the Constitu- tion, is equal pay for equal work for both men and women. The provision of Article 39(d) has been relied upon by the petitioners. The Directive Principles contained in Part-IV of the Constitution, though not enforceable by any court, are intended to be implemented by the State of its own accord so as to promote the welfare of the people. In- deed, Article 37 provides, inter alia, that it shall be the duty of the State to apply these principles in making laws. Even leaving out of our consideration Article 39(d), the principle of "equal pay for equal work", if not given effect to in the case of one set of Government servants holding same or similar posts, possessing same qualifications and doing the same kind of work, as another set of Gov- ernment servants, it would be discriminatory and violative of Articles 14 and 16 of the Constitution. Such discrimina- tion has been made in respect of the petitioners, who are the Staff Artists of Doordarshan, by not giving them the same scales of pay as provided to their counterparts in the Films Division under the same Ministry of Information and Broadcasting. The petitioners are, therefore, entitled to the same scales of pay as their counterparts in the Films Division."

Be that as it may, since pay fixation is the job of the executive and expert and Government is ready and willing to take a decision in the matter of the petitioners, the petitioners are permitted to make the representations before the State Government within 15 days from today and in turn, the State Government will do well and consider the 15 cases of the petitioners for grant of two advance increments at par that the teachers who have passed their B.Ed. decree/B.T.I. training on government expenses keeping in view the observation made hereinabove, as two advance increments were granted as incentive to those government teachers who have obtained their B.Ed.

decree/B.T.I. training on their own expenses, within a period of three months from the date of receipt of representations of the petitioners along with copy of this order. It is made clear that this Court has not made any direction to the respondents to grant such benefit to the petitioners.

9. With the aforesaid observations, all writ petitions stand finally disposed of. No order as to cost(s).
