Criminal Writ Petition No. 767 of 2011 Davinder Kumar has preferred this petition under Article 226 of the Constitution of India, for issuance of writ in the nature of Habeas Corpus with a roving writ, for the release of detenues namely Kulbir Kaur wife of the petitioner and Simranpreet Kaur minor daughter of the petitioner, who are stated to be in illegal custody of respondents No.4 to 8.

Learned counsel for the petitioner states that the detenues namely Kulbir Kaur and Simrajpreet Kaur were taken away by respondents No.4 to 8, who are related to the alleged detenues.

Learned counsel for the petitioner states that a representation dated 27.03.2011 (Annexure P-1) was sent to SHO, Police Station Division No.1, Jalandhar, which is still pending. Crl. Writ Petition No. 767 of 2011 (O&M) -2-

On the asking of the Court, Mr. P.S. Sidhu, Addl. AG, Punjab, who is present in Court, accepts notice on behalf of respondent-State.

Learned counsel for the petitioner is directed to supply six copies of complete paper book alongwith representation dated 27.03.2011 (Annexure P-1) to learned State counsel during the course of the day.

This petition is disposed of with direction to SHO, Police Station Division No.1, Jalandhar to dispose of the representation dated 27.03.2011 (Annexure P-1) within one month from the date of receipt of certified copy of this order by passing a speaking order.
