ORAL ORDER
2 12-12-2019Petitioner seeks regular bail in connection with Bodh Gaya Case No.434 of 2019 registered for the offence punishable under Sections 341, 342, 323, 354B, 384, 427, 504, 506, 376, 511 and 120B of IPC and Sections 3, 5, 6 and 7 of Immoral Traffic Act, 1956.
As per F.I.R. petitioner and one co-accused has taken the informant and other on the plea of having a dance program, but in spite of performing any program, they tried to outrage the modesty and also tried to commit rape upon the informant and others.
Submission of the learned counsel for the petitioner is that as a matter of fact, there was some dispute with respect to payment of wage and as such, they have falsely been implicated Patna High Court CR. MISC. No.82468 of 2019(2) dt.12-12-2019 2/2 in this case. There is no allegation against the petitioner of trying to outrage the modesty or attempt to commit of rape upon them. He is in custody for more than two months. It has also been submitted that the person against whom, there is allegation of trying to outrage modesty, has been granted anticipatory bail, vide order dated 04.12.2019 passed in Criminal Misc. No. 79081 of 2019.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Gaya, in connection with Bodh Gaya Case No.434 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he will not try to threaten the informant or her family members or try to tamper with the evidence.
