1. The issue under consideration arising out of the second appeal dated 17.01.2020 include non-receipt of the following information sought by the appellant through the RTI application dated 28.08.2019 and first appeal dated 11.10.2019:-

(i) What are the steps that have been taken by United Bank of India Dullabcherra Branch for arrange and disburse of capital subsidy to the selected beneficiaries under NFDB Scheme vide letter No AFK 304 2014 2015 748 dated 28.10.2014 and DUC ADV MTF 2015 dated 10.10.2019. Furnish certified true copies of these subsidy claimed present status report prior to date 28.08.2019.

(ii) What are the steps that have been taken by United Bank of India Dullabcherra Branch for sanction of loan Assistance to the selected women SHGs under Page 1 of 4 NRLM Day NRLM vide letter No LNGO 2016 P 125 dated 01.11.2016. Furnish the certified true copies of these loan proposal pending description and present status report of each loan proposal prior to date 28.08.2019.

(iii) What are the steps that have been taken by United Bank of India, Dullabcherra Branch for sanction of loan assistance to the selected women SHGs under NRLM Day NRLM vide letter No LNGO 2016 P 124 dated 20.10.2016. Furnish the certified true copies of these loan proposal pending description and present status report prior to date 28.08.2019.

(iv) What are the steps that have been taken by United Bank of India Dullabcherra Branch for sanction of loan assistance to the selected women SHGs under DEDS of NABARD vide his letter No DUC ADV PR DEDS Subsidy 2017 18 dated 21.08.2017 and these loan proposals sponsoring letter No DVK Loan 2017 18 621 619 617 615 611 613 625 623 dated 5th Aug 2017. Furnish the certified true copies of these loan proposal pending description and present status report of each loan proposal prior to date 28.08.2019.

(v) What are the steps that have been taken by United Bank of India Dullabcherra Branch for arrange and disburse of Capital Subsidy to the selected beneficiaries under NFDB Scheme vide letter No AFK 304 2015 2016 1459 60 dated 17.02.2016 and BR DUC NFDB 2015 dated 23.12.2015 and BR DUC NFDB 2015 dated 24.06.2015. Furnish the certified true copies of these subsidy claimed present status report of each loan proposal prior to date 28.08.2019.

(vi) What are the steps that have been taken by United Bank of India Lead Bank Office Karimganjand Regional Office Cachar region for arrange and release of Capital Subsidy to the selected beneficiaries under DEDS of NABARD vide letter No DUC ADV PR MTF 15 16 01dated 31.03.2016. Providecertified true copies of these subsidy claimed present status report prior to date 28.08.2019.

Succinctly facts of the case are that the appellant filed an application dated 28.08.2019 under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), United Bank of India (Now Punjab National Bank), Assam, seeking aforesaid information. The CPIO did not reply to the appellant. Aggrieved by the same, the appellant filed first appeal dated 11.10.2019. The First Appellate Authority (FAA) did not pass any order. Aggrieved by that, the appellant filed second appeal dated 17.01.2020 before the Commission which is under consideration.

3. The appellant has filed the instant appeal dated 17.01.2020 inter alia on the grounds that no reply was received from the respondent. The appellant requested the Commission to direct the CPIO to provide the complete information and take necessary action as per Section 20 (1) of the RTI Act.

4. Perusal of the records submitted by the appellant while filing the second appeal dated 17.01.2020 reveals that neither the CPIO nor the FAA provided any information or any reply to the appellant.

5. The appellant remained absent and on behalf of the respondent Shri Jibanshu Paul, CPIO, Punjab National Bank, Cachar, attended the hearing through video conference.

5.1. The respondent while defending their case inter alia submitted that the RTI application and the first appeal were not received by the respondent hence reply to the same could not be given to the appellant.

6. The Commission after adverting to the facts and circumstances of the case, hearing the respondent and perusal of records, observed that no reply was given by the respondent. Assuming that the respondent had not received the RTI application earlier, they could have obtained the relevant documents from the Registry or accessed the file from the Commission's web portal upon receipt of the hearing notice. However, the respondent has not made any such efforts and therefore, the CPIO is cautioned to be more careful in future. Further, the respondent is directed to procure the RTI application and provide proper reply/information to the appellant, within three weeks from the date Page 3 of 4 of receipt of this order. With the above observation and directions, the appeal is disposed of.

Copy of the decision be provided free of cost to the parties.
