महीनों के लिए महिलाओं के प्रति अपराध के आंकड़े भी विगत वर्ष की इसी अवधि की तुलना में कमी का रुझान इंगित करते हैं। तथापि, सभी चारों वर्षों संबंधी आंकड़े मिले-जुले रुझान को दर्शाते हैं। …( व्यवधान)

श्री श्रीप्रकाश जायसवाल : वर्ष २००१, २००२, २००३, २००४ तथा २००५ (१५ जुलाई तक) के दौरान दहेज मृत्यु, बलात्कार, महिलाओं का उत्पीड़न, दहेज से संबंधित भारतीय दंड संहिता की धारा ४०६, भारतीय दंड संहिता ४९८ - पति अथवा ससुराल पक्ष द्वारा क्रूरता, दहेज प्रतिषेध अधनियम, अपहरण/व्यपहरण और महिलाओं से छेड़छाड़ जैसे मुख्य अपराध शीर्षों के अंतर्गत राष्ट्रीय राजधानी क्षेत्र दिल्ली में महिलाओं के प्रति सूचित अपराधों की संख्या इस प्रकार थी :--
२००१ - ३,८७० २००२ - ४,१०६ २००३ - ४,३३८ २००४ - ५,५६८ जनवरी से १५ जुलाई, २००४ तक - ३,०४२ जनवरी से १५ जुलाई, २००५ तक - २,७०६ उपर्युक्त आंकड़े दर्शाते हैं कि वर्ष २००१ की तुलना में वर्ष २००२, २००३ तथा २००४ के दौरान दिल्ली में महिलाओं के प्रति अपराध की घटनाओं में समग्र रूप से वृद्धि हुई है। चालू वर्ष के दौरान जनवरी से १५ जुलाई की अवधि में महिलाओं के प्रति अपराध के आंकड़े विगत वर्ष की इसी अवधि के आंकड़ों की तुलना में समग्र अपराध दर में कमी दर्शाते हैं। तथापि, यह सच है कि वर्ष २००३, २००४ और चालू वर्ष के पहले सात महीनों के दौरान दिल्ली में बलात्कार के मामलों में वृद्धि हुई cè[h15] ।
महिलाओं के प्रति अपराध की घटनाओं की रोकथाम के लिए दिल्ली पुलिस ने हाल में कारगर कदम उठाए हैं। इन कदमों में शामिल हैं - महिलाओं के प्रति अपराध प्रकोष्ठ को सुद्ृढ़ करना, रेप क्राइसेस इन्टरवेंशन सेंटर की स्थापना, महिला न्यायाधीशों वाले विशेष सत्र न्यायालयों का गठन, महिला पुलिस अधिकारियों द्वारा बलात्कार और अन्य संबंधित अपराध की जांच अथवा ऐसे मामलों में जांच अधिकारियों के साथ महिला पुलिस को संबद्ध करना, कानूनी जागरुकता और प्रचार अभियान चलाना, महत्वपूर्ण महिला महाविद्यालयों में गश्त करने वाले पीसीआर वाहनों में महिला पुलिस कांस्टेबल की तैनाती, महिलाओं के साथ छेड़खानी और उत्पीड़न को समाप्त करने तथा अपराधियों पर निगरानी रखने के लिए शहर में महत्वपूर्ण स्थानों पर सादे कपड़ों में पुलिस कार्मिकों की तैनाती, महिला हैल्प लाइन नं.१९९१ की स्थापना, महिलाओं की तात्कालिक, संकट परिस्थिति एवं आपातकाली कॉलों को सुनने के लिए २४ घंटों महिला मोबाइल टीम का गठन, आदि। इन कदमों के परिणामस्वरूप, महिलाओं के बीच अपराध की घटनाओं को रिपोर्ट करने के संबंध में व्यापक जागरुकता आई है।
दुर्भाग्यवश, दिल्ली पुलिस द्वारा उठाए गए इन कदमों के बावजूद, हाल ही में जल्दी-जल्दी बलात्कार के दो मामले घटित हुए। इन मामलों को व्यापक मीडिया कवरेज प्राप्त हुई। पहला मामला धौला कुंआ से एक लड़की के व्यपहरण तथा ७/८ मई, २००५ की रात्रि को चलती कार में उसके साथ बलात्कार से संबंधित है। इस मामले में दिल्ली पुलिस दोषी व्यक्तियों में से एक को गिरफ्तार करने में सफल रही है। दिल्ली पुलिस ने अन्य अभियुक्तों को पकड़ने के लिए अनेक कदम उठाए हैं। दूसरा मामला, जो इसी प्रकार का है, मायापुरी से एक महिला के व्यपहरण तथा २० जुलाई, २००५ को चलती कार में उसके साथ बलात्कार से संबंधित है। इस मामले को हल करने के लिए दिल्ली पुलिस ने काफी व्यापक अभियान चलाया है।
दिल्ली में अपराध की घटनाओं को प्रभावित करने वाले कारणों में से एक, जनसंख्या का भिन्न जातीय स्वरूप है। अपराध में वृद्धि और शहर की जनसंख्या के बीच एक सकारात्मक सह-संबंध है। जनसंख्या के अलावा, अन्य कारण जैसे यायावर जनसंख्या, शहरीकरण और उद्योगीकरण के कारण पड़ोसी राज्यों से जनसंख्या का पलायन, बेरोजगारी, आर्थिक असमानता तथा घटते सामाजिक और पारिवारिक बंधन भी अपराध की घटनाओं पर प्रभाव डालते हैं।

प्रो. विजय कुमार मल्होत्रा : अध्यक्ष जी, माननीय मंत्री जी के बयान से हमें बहुत निराशा हुई है। यह बहुत ही डिस्कस्िंटग और शर्मनाक स्थिति है और ऐसा ही इनका बयान है। बहुत-सी बातें ऐसी हैं जिन पर बहुत गहरा वाद-विवाद होना चाहिए इसलिए उन बातों कों मैं यहां उठाना नहीं चाहता हूं। महिलाओं पर अत्याचार, चुड़ेले बता कर उनकी हत्या कर देना, पारिवारिक सम्मान के लिए हत्या, दहेज समस्या, ये दूसरे प्रश्न हैं, परन्तु आपका यह कहना कि सिर्फ बलात्कार की दो घटनाएं हुई हैं, इससे ज्यादा गलत बयान संभव नहीं हो सकता है। मैं पिछले सात दिनों के अखबार आपके सामने पढ़ रहा हूं। पहला अखबार २४ जुलाई का है - “Unsafe Delhi - three rapes reported in 24 hours”. एक दिन के अंदर, २४ घंटों में तीन बलात्कार हुए। दूसरा अखबार २५ जुलाई का है - “25 year old raped in Delhi, two held[r16] .” “Six held after South Delhi shoot-out and rape”; “Yet again rape in a moving car”; “Another morning another nightmare – another Delhi woman falls victim to a gang rape in a car not from Dhaula Kuan”. “राजधानी महिलाओं के लिए कितनी सुरक्षित” ये सात दिन के अखबार हैं।
अध्यक्ष महोदय, मंत्री महोदय का यह कहना कि दिल्ली में हाल ही में जल्दी-जल्दी सिर्फ दो बलात्कार की घटनाएं हुई हैं, ठीक नहीं है। सारी दिल्ली बलात्कार की घटनाओं से दहल रही है, सारी दिल्ली में असुरक्षा की भावना है, महिलाओं का रात को निकलना बन्द है। इन घटनाओं से जो स्थिति पैदा हुई है, उनमें इस प्रकार से एक केजुअल सा बयान देना, मुझे लगता है कि यह ठीक नहीं है, यह बहुत शर्मनाक बयान है।
अध्यक्ष महोदय, मैं कहना चाहता हूं कि श्रीमती शीला दीक्षित जी से जब इस बारे में पूछा गया, तो उन्होंने कहा कि मेरे पास ला-एंड-आर्डर नहीं है। चूंकि शान्ति-व्यवस्था दिल्ली सरकार के अंडर नहीं है इसलिए इसकी जिम्मेदारी गृह मंत्री महोदय की है। अभी मैं आपको सुश्री गरिजा ब्यास का एक बयान पढ़ कर सुनाना चाहता हूं। वे इन्हीं की पार्टी की हैं और महिला आयोग की अध्यक्षा हैं। उन्होंने बयान दिया है जो अखबारों में छपा है। उन्होंने “ वक्षिप्त महिला के साथ बलात्कार ” की एक घटना का जिक्र किया जो अखबार में छपा है और बाद में वे कहती है कि दिल्ली महिलाओं के लिए सुरक्षित नहीं रही। देश की राजधानी होने के कारण, काम की तलाश में देश के कोने-कोने से महिलाएं यहां आती हैं, लेकिन पर्याप्त सुविधा और सुरक्षा के अभाव में उन्हें हर पल अपनी जान और इज्जत जाने का डर बना रहता है।
अध्यक्ष महोदय, दिल्ली की मुख्य मंत्री श्रीमती शीला दीक्षित जी के बयान, सुश्री गरिजा ब्यास के बयान और सारे मीडिया के कहने के बाद, देश में जिस प्रकार की स्थिति पैदा हुई है, उसे देखते हुए मैं समझता हूं कि गृह मंत्री को तुरन्त अपने पद से त्यागपत्र देना चाहिए।
अध्यक्ष महोदय, यह मानना कि दिल्ली पुलिस इन घटनाओं को नहीं रोक सकती, आप शिक्षा का प्रबन्ध करिए, आप दूसरे प्रबन्ध करिए और केवल एक एस.एच.ओ. को सस्पेंड कर देना और सस्पेंड भी नहीं किया है, सिर्फ ट्रांसफर किया है, इससे घटनाएं नहीं रुकेंगी। फिर यह कहना कि Home Minister Called Delhi Police Commissioner, <ºÉ |ÉBÉEÉ® ¤É½É £ÉÉ®ÉÒ ¤ÉªÉÉxÉ nä näxÉÉ, <ºÉºÉä àÉÉàÉãÉÉ ºÉàÉÉ{iÉ cÉä VÉÉAMÉÉ, <ºÉºÉä àÉÉàÉãÉÉ ¶ÉÉxiÉ cÉä VÉÉAMÉÉ, ªÉc ºÉàÉZÉxÉÉ ~ÉÒBÉE xÉcÉÓ cè* ÉÊnããÉÉÒ BÉEÉÒ ÉκlÉÉÊiÉ BÉEä ÉÊãÉA MÉßc àÉÆjÉÉãÉªÉ ÉÊVÉààÉänÉ® cè.* अध्यक्ष महोदय, मंत्री जी ने अपने बयान में कहा कि दिल्ली में बाहर के लोग आते हैं, वे स्थिति को बिगाड़ रहे हैं। मैं आपसे पूछना चाहता हूं कि दिल्ली के अंदर जो माफिया गैंग आते हैं, जो बलात्कारी आते हैं, उनको दिल्ली में आने से रोकने के लिए आपने क्या उपाय किए हैं ?
महोदय, अभी एक साल पहले तक, दिल्ली में बार-बार कहा गया था कि हरेक दिल्ली निवासी को एक आइडेंटिटी कार्ड देंगे और दिल्ली में हर आदमी के पास एक पहचान होनी चाहिए। बलात्कारी दिल्ली आते हैं, दूसरे लोग आते हैं, लेकिन उनको आप रोक नहीं पाते हैं। गुड़गांव में पुलिस ७०० मजदूरों को जख्मी कर सकती है, लेकिन बलात्कारियों को पकड़ने में असमर्थ है, उनका मुकाबला नहीं कर सकती है। आपने अपने बयान में यही बात कही लगती है।
अध्यक्ष महोदय, मैं दूसरी बात कहना चाहता हूं कि अभी देश भर की बहुत सी बातों का यहां जिक्र हुआ, इमराना के केस का जिक्र हुआ। इमराना के केस के बारे में मैं गृह मंत्री जी से जानना चाहता हूं कि उसके ससुर ने सारी पवित्रताओं की नष्ट करते हुए, उसके साथ बलात्कार किया और उसके बाद एक फतवा दिया गया कि उसे अपने पति को अपना बेटा मान ले और ससुर के साथ पत्नी के रूप में रहना चाहिए। मैं जानना चाहता हूं कि क्या इमराना के मामले में फतवा की पॉलटिक्स चलेगी ?

प्रो. विजय कुमार मल्होत्रा : अध्यक्ष जी, जहां देश में कॉमन क्रमिनल कोड है, कॉमन क्रमिनल कोड में कोई भी व्यक्ति अगर बलात्कार करता है तो उसको फांसी की सजा होनी चाहिए, यह मांग भी करते हैं, आपकी तरफ से भी कहा जाता है, परन्तु एक व्यक्ति बलात्कार करे, ससुर बलात्कार करे तो उसको पकड़ने की बजाय, उसको फांसी देने के बजाय उसे ईनाम दिया जाये और गृह मंत्री, प्राइम मनिस्टर जैसे लोग चुप रह जायें, उसके ऊपर एक शब्द न बोलें, यह फतवा कंट्री में कब तक चलेगा? क्या अपने राजनैतिक स्वार्थों के लिए, अपने वोट बैंक को बचाने के लिए वहां पर महिलाओं के बलात्कार को बार-बार संरक्षण दिया जायेगा, यह हम जानना चाहते हैं? अध्यक्ष महोदय, मैं यह कहना चाहता हूं कि गृह मंत्री जी को तुरन्त इस्तीफा देना चाहिए।…( व्यवधान)

Delhi is not only the political capital of our country. It is also the capital of criminals. It is the capital of crimes. Criminal activities and atrocities against women are going on here. … (Interruptions)
MR. SPEAKER: Too many whisperings are going on. This is the Parliament of India. Nobody seems to remember it. You keep quiet. It is not a matter of joke. Such an important matter is being discussed and the House is not maintaining at least sobriety here.
SHRI AJOY CHAKRABORTY : Sir, criminal acts are growing day by day. Criminal acts such as atrocities against women are growing everyday. It is not so only in Delhi. This is happening all over the country. Atrocities against women such as rape, kidnappings, abduction, outrage of modesty, dowry deaths of women are increasing day by day. The police is very much effective in curbing the trade union movement in Gurgaon. But the police is ineffective in curbing the criminal activities in Delhi and other places. Sir, I have already said that this is not the concern of ‘A’ party or ‘B’ party alone. It is the concern of the whole country as such. The women folk are subject to torture, they are subject to rape and kidnappings.

SHRI AJOY CHAKRABORTY : In Manipur, a college girl was raped earlier. Last year, a student of the Law College of Delhi was also raped. This heinous crime is growing day by day.

In this situation, my first question to the hon. Minister is this. Is the Government of India going to consider setting up of a Special Task Force of Police to curb the criminal activities against women and prevent women from rape, abduction, kidnapping, dowry death and outrage of modesty[bru17] ?
Law and order situation is a State subject. I would like to know whether the Government of India has advised the State Governments to establish Special Task Force to prevent these kinds of criminal activities and atrocities on women. Secondly, may I know from the hon. Minister whether the Government of India is considering any proposal to establish a Special Police Cell by women officials to investigate all the matters and all the cases regarding the atrocities on women and cases relating to women? Thirdly, may I know from the hon. Minister whether the Government of India is considering any proposal to establish a police cell, which would investigate only cases which are related to the atrocities on women?
MR. SPEAKER: He has mentioned it in his statement.
SHRI AJOY CHAKRABORTY : It appears from the statement of the Minister and from the statistics provided by the NCRB that the number of cases and the number of crimes are on the rise in Delhi and other parts of the country. My questions to the hon. Minister are; in regard to those crimes, how many cases were registered before the different police stations? In how many cases chargesheets had been submitted before the appropriate court? In how many cases the final report had been submitted before the courts? In how many cases criminals, the accused, had been convicted and in how many cases the accused had been acquitted? May I know from the hon. Minister whether the Government is considering to pay compensation to the womenfolk who were victims of rape, outrage of modesty, dowry death, etc.? Lastly, I submit before your honour that this is the concern of all the countrymen. So, the Government should take serious efforts to curb criminal activities on the women. This is the agony of the day. Everybody is fuming. This is the very serious concern of the day. All of us, cutting across party lines, should think about it seriously.
MR. SPEAKER: Hon. Members, please ask only questions. It is not a matter of elaboration.
DR. SUJAN CHAKRABORTY Sir, this is a matter of grave concern. I believe that all Members should be equally concerned with this matter. This is obviously not a question of indicting 'X' or 'Y'. The way the report is coming over the last few months, it is very shameful to the whole country. This is not just a question of one or two or three months. If we look at the reports of the last seven or eight or ten years, increasing incidents of similar nature are being reported. All of us know the incidents of Dhaula Kuan and Mayapuri. Rape in a moving car is a new pattern. Probably, earlier such reports were not there. Rape in a moving car is a new thing. We know the incident involving a Swiss diplomat. Again, it was very shameful to the entire country. She was raped. She had to go back to her country. What is the answer to that from a country like India? What is the answer from Delhi? Similarly, all of us know the Tandoor case. One political leader was also involved in that, in the name of ----.
MR. SPEAKER: Do not take names.
DR. SUJAN CHAKRABORTY : Okay, I will not take names.
A political leader was also involved. Tandoor case was also very grave incident. So, similar cases are on the increase in Delhi. I agree with my friend Shri Ajoy Chakraborty, when he said that Delhi is not only the political capital of the country but it is also the capital for these sorts of activities. National Crime Record Bureau statistics show that 450 cases of rape take place in Delhi every year. Thirty per cent of these atrocities are against the child and young girls. What is the answer from the Government? If you look at the action taken against these evils, you will find that no proper action is being taken against them. The hon. Minister, probably in the third para of his statement, has showed it in such a manner that these cases are coming down in the country[r18] .
In 2001, it was 1,33,935. He was boastfully mentioning that in 2004, it was 1,33,865. In number, it is not differing. In percentage, it is not differing. But still, the Government is boasting that ‘yes’ the figure has come down by 70. It is not coming down even in the percentage figure. In the fourth and the fifth paras, we can see while the incident in the country, according to the Statement, is coming down, the incident in Delhi is on the rise. In 2001, it was 3,870; in 2002, it was 4106; in 2003, it was 4338; and in 2004, it was 5568.
MR. SPEAKER: That is all in the statement. Please come to your question.
DR. SUJAN CHAKRABORTY : Obviously, this concern should be taken care of by all concerned and the Government equivalently.
Sir, female foeticide also is a matter of concern. This is the National Capital. This is not a remote corner of the country. Here, the female foeticide is also on the rise. Thereby, I believe, the Government should take very, very serious approach and give a thought on this. The Chief Minister of Delhi has expressed her dissatisfaction. She has also expressed that she is not in a position to do because the police is being controlled by the Government of India.
Sir, in the 172nd Report of the Law Commission, it has been indicated that various lapses are there in our criminal procedure and in the entire procedure of tackling these issues. I would like to know whether the Government would look into the conviction cases of all these evils, which is very low. Probably, it is not more than four per cent, or even less than that. So, why is it so less? Why is it that many of the cases are not getting registered by the police? Why is it that the police is not taking as much interest as in other cases for all these evils?
MR. SPEAKER: Please, put your question.
DR. SUJAN CHAKRABORTY : Probably, the law and the policing is also very much defective. After 1983, some sort of amendment in the law was there. But after that, no amendment has taken place. The entire law procedure and the entire procedure of tackling these issues should be well spelt. In many other and even Commonwealth countries, the procedure has been changed. We have never changed our procedure.

DR. SUJAN CHAKRABORTY : In the recent past, Australia has changed its procedure, Canada has changed its procedure, and even South Africa also has changed its procedure. The Commonwealth countries have changed their procedures, but we have not.

श्री श्रीप्रकाश जायसवाल : VÉÉÆSÉ |ÉÉʵÉEªÉÉ àÉå àÉÉÊcãÉÉ पुलिस अधिकारियों को शामिल करने की व्यवस्था की गयी है। यह एक प्रभावी कदम के रूप में उठाया गया है। कानूनी जागरूकता और प्रचार अभियान चलाए जा रहे हैं। मैं मल्होत्रा साहब से कहूँगा कि इस प्रचार अभियान में आप भी चलें और हम भी चलें। इससे अभियान ज्यादा सफल होगा। हमें राजनीति से ऊपर उठकर देखना पड़ेगा, केवल इस्तीफा मांगने से समस्या का समाधान नहीं होगा। महत्वपूर्ण महिला विद्यालयों में गश्त लगाने वाले पीसीआर वाहनों में महिला पुलिसकर्मियों की तैनाती की गयी है। महिलाओं के साथ छेड़खानी और उत्पीड़न समाप्त करने और ऐसे अपराधियों पर निगरानी रखने के लिए शहर के महत्वपूर्ण स्थानों पर तथा बसों में जिस तरह की छेड़खानी की घटनाएं होती हैं, उनको रोकने के लिए सादे वेश में पुलिसकर्मी तैनात किए गए हैं। ये पुलिसकर्मी ऐसे लोगों को पकड़ेंगे और अपराधों की रोकथाम करेंगे। महिला हेल्प लाइन ‘१९९१’ की स्थापना की गयी है। किसी भी महिला को अगर किसी तरीके की शिकायत हो तो इस नम्बर पर तुरन्त शिकायत दर्ज करा सकती है। महिलाओं की आपातकालीन काल्स को सुनने के लिए २४ घण्टे महिला मोबाइल टीम का गठन किया गया है, लेकिन इसमें कोई शक नहीं है कि दिल्ली हमारे देश का ऐसा राज्य है जहां ४.५ लाख से अधिक लोग प्रति वर्ष बाहर से आते हैं। उनके दिल्ली में आने के समय उनकी शिनाख्त नहीं हो सकती है कि उनका पिछला रिकॉर्ड कैसा रहा है, वे किस सूबे से आए हैं? यह आज तक नहीं किया जा सका है।

श्री श्रीप्रकाश जायसवाल : जहां तक दूसरे राज्यों की बात है, दूसरे राज्यों में जिस तरीके से बलात्कार की घटनाएं बढ़ी हैं, उनकी रोकथाम के लिए भारत सरकार ने प्रयास किए हैं। भारत सरकार ने यह किया है कि सभी राज्यों को सलाह दी गयी है कि वे पुलिस सैल बनाएं।कुछ राज्यों में ये पुलिस सैल पहले से कार्यरत हैं जैसे कि अपने राज्य उत्तर प्रदेश के बारे में बता सकता हूँ कि वहां पुलिस सैल आज से नहीं बल्कि पिछले कई वर्षों से काम कर रही है। ऐसी पुलिस सैलों को और अधिक इफेक्टिव बनाने की सलाह दी गयी है जिससे कि इस तरह की घटनाओं की पुनरावृत्ति न हो।[cmc22] सभी राज्यों को यह भी सलाह दी गई है कि महिला पुलिस थाने बनाए जाएं और महिला पुलिस को और ज्यादा एक्टिव किया जाए। महिला पुलिस को जितना एक्टिव किया जाएगा, उतना ही इस तरह के अपराधों पर अंकुश लगाया जा सकेगा।
अध्यक्ष जी, मैंने जो ये स्पष्टीकरण दिए हैं, मैं इतना ही आपके माध्यम से सदन से कहना चाहता हूं कि भारत सरकार पूर्ण रूप से सदन की भावनाओं से अवगत है कि बलात्कार जैसे कांडों पर अंकुश लगना चाहिए। हमारे देश की कानून व्यवस्था में, दिल्ली सहित, सुधार आना चाहिए, क्योंकि बलात्कार की घटना हमारे देश के कानून और व्यवस्था पर कलंक के समान है। इसलिए समय-समय पर हमारी सरकार, जो भी सम्भव हो सकेगा, कदम उठाएगी। मैं माननीय सदस्यों और खास तौर से मल्होत्रा जी से अनुरोध करना चाहूंगा कि वे हमें सहयोग दें। आपको दिल्ली के भूगोल के बारे में ज्यादा जानकारी है, यहां के इतिहास के बारे में भी आपको ज्यादा जानकारी है इसलिए आप समय-समय पर हमें बताते रहेंगे, तो यह सही होगा।…( व्यवधान) मैं अंत में एक अनुरोध और करना चाहता हूं। …( व्यवधान)
