1. It is unfortunate that the writ petition which was admitted on the first date of its listing i.e. 16.04.2013 could not be taken up for hearing till today.
2. We have used the expression unfortunate for the reason the writ petition has become infructuous by default as on today.
3. Issue concerns grant of bonus marks and the grievance of the petitioners is that bonus marks for past experience have been restricted only to those who have directly worked on ad hoc, temporary or contract basis in a Government department or under Government itself and not through Non-Government Organisation.
4. A perusal of the pleadings would show that some of the writ-petitioners claim to be working on contract basis directly (3 of 3) [CW-5942/2013] appointed in different departments of the Government and some through NGOs'.
5. There is no specific averment as to when was the advertisement, if any, issued inviting applications. Challenge is to a notification dated 29.01.2013.
6. We are in the year 2018. This could be the reason nobody appears for the petitioners today.
7. The petition could be disposed of as even infructuous or dismissed on account of non prosecution. We would prefer the latter.
