Section 355 in The City of Nagpur Corporation Act, 1948

355. Power of entry on lands adjacent to works.

(1)Any municipal officer duly authorised to carry out works may enter upon any land adjoining or within one hundred yards of any works authorised by this Act or by any rule or by-law made thereunder and deposit any earth, gravel, sand, lime, bricks, stone, or other materials necessary for such works, or for any other purpose connected with the carrying on of such works.
(2)Such officer shall before depositing materials under sub-section (1), give the owner or occupier of the land reasonable notice of his intention to make such entry, and of the purpose thereof, and shall, if so required by the owner or occupier, set apart by sufficient fences so much of the land as may be required for the purposes mentioned in the said sub-section.
(3)The municipal officer shall not be bound to make any payment, tender or deposit before entering upon any land under sub-section (1), but shall do as little damage as may be, and the [Commissioner] [This word was substituted for the words 'Chief Executive Officer' by Bombay 79 of 1958, Section 3, Schedule.] shall pay compensation to the owner or occupier of the land for such entry and for any temporary damage that may be done in consequence thereof, and shall also pay compensation to the said owner for any permanent damage resulting therefrom.
