(through Smt. Aprajita Jaggi, Regional PF

Date of Decision : 5.5.2009

Facts

The matter, in short, is that the appellant Shri Raj Kumar & Shri Jagdish Chand are purported to have sought information in regard to the month-wise remittances by their employer M/s Nelson Health Club, Hotel Samrat, in their respective PF account numbers from 1992 to 2002.

2. The CPIO had provided information for 03 years starting from 2000-01 to 2002-03. On appeal, the Appellate Authority had observed that information for all the years had not been provided and directed the CPIO to provide information for the entire period for which information has been sought.

3. As the appellants were not provided the requisite information, they have filed the present appeals before the Commission. The matter was heard on 5.5.2009. The appellants did not appear before the Commission. The public authority is represented by the officer named above. It is her submission that, on verification, the appellants have not been found to be residing at the addresses given by them in the RTI applications and that as it is'personal information' it cannot be disclosed to a third party. It is also her say that efforts made to contact the appellants have drawn a blank. It is also her say the organization has no objection to providing information to the appellants so long as it is satisfied that the information is being sought by the appellants themselves and not by anyone else.

DECISION

4. Needless to say, the financial information sought by the appellants is personal in nature and can be disclosed only to them. As they have not been found to be residing at the addresses given by them in the RTI application, the view taken by the CPIO appears to be correct. Even so, the CPIO is hereby advised to make a last ditch effort to trace out the appellants at the given addresses and if they confirm having filed RTI applications, then they may be provided the information sought by them.

5. The aforesaid appeals are disposed of subject to the above directions.
