HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH

?Court No. - 16

Case :- U/S 482/378/407 No. - 7186 of 2019

Applicant :- Shani Singh @ Amit Kanjar

Opposite Party :- State Of U.P.

Counsel for Applicant :- Anil Kumar Sharma,Brijendra Kumar Tiwari

Counsel for Opposite Party :- G.A.

Hon'ble Pankaj Bhatia,J.

Heard learned counsel for the applicant and learned AGA for the State.

Learned counsel for the applicant has argued that the applicant has been enlarged on bail in all the cases. The details of the said cases has been disclosed.

The short submission of the counsel for the applicant is that the applicant is a very poor person and is not in a position to arrange separate sureties for all the five cases. He has further placed reliance on the order of the Apex Court dated 29.10.2018 to stress that the surety in one of the cases may be treated to surety in all the cases.

Considering the averment made at the Bar as well as the order of the Hon'ble Apex Court the request merits acceptance. The surety filed by the applicant in one of the five cases shall be treated to be adequate surety for all the five cases being Case Crime No. 44 of 2019 under sections 41, 411 IPC, Police Station Ghazipur, District Lucknow, Case Crime No. 109 of 2019 under sections 392, 411 IPC, Police Station Ghazipur, District Lucknow, Case Crime No. 277 of 2019 under sections 392, 411 IPC, Police Station Ghazipur, District Lucknow, Case Crime No. 123 of 2019 under sections 392, 411 IPC, Police Station Ghazipur, District Lucknow, Case Crime No. 434 of 2019 under sections 392, 411 IPC, Police Station Ghazipur, District Lucknow.
