Prayer: Writ Petition filed under Article 226 of the Constitution of India,
praying for the issuance of a direction in the nature of Writ of Certiorarified
Mandamus, calling for the records of the first respondent in
Ref.No.AB1/21033/2013 dated 09.09.2019 and consequential panel for the
year 2016-17 of the first respondent in proceedings No.AB1/32897/2015
dated 12.10.2020 and quash the same and consequently direct the first
respondent to prepare a fresh Seniority List by following the judgment of the
Hon'ble Division Bench in W.A.No.811 of 2011 etc., dated 17.04.2018 and
the Tamil Nadu Forest Subordinate Service Rules and pass such further
orders.

ORDER
This writ petition is filed to quash the impugned order passed by the first respondent in Ref.No.AB1/21033/2013 dated 09.09.2019 and consequential panel for the year 2016-17 of the first respondent in proceedings No.AB1/32897/2015 dated 12.10.2020 and directing the first respondent to prepare a fresh Seniority List by following the judgment of the Division Bench of this Court in W.A.No.811 of 2011 etc., dated 17.04.2018 and the Tamil Nadu Forest Subordinate Service Rules.
2. When the matter came up for hearing, learned counsel appearing for the petitioners as well as learned Government Advocate appearing for the first respondent are at idem that the matter was covered by the orders of this Court in W.P.No.19165 of 2020 in the case of M.Kalan and others Vs. The Principal Chief Conservator of Forest, Panagal Buildings, Saidapet, https://www.mhc.tn.gov.in/judis 4/6 W.P.No.16282 of 2020 Chennai – 600 015 and others, which held as follows:
“9. Considering the above facts and circumstances, the respondent is directed to consider the objections raised by the petitioners in the light of the order of notional promotion given to the similarly placed person in his order dated 09.07.2024 and pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.”
3. In view of the above ratio laid down by this Court, the respondents are directed to follow the above order and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
4. In the result, this writ petition stands disposed of with the above observations and direction. No costs. Consequently, connected miscellaneous petitions are closed.
