O R D E R (ORAL)
Per: Smt. Urmita Datta (Sen), Judicial Member
1. The applicants have approached this Tribunal under Section 19 of the Administrative Tribunals Act, 1985, praying for the following relief(s):
"a) Liberty may be granted under Rule 4(5)(a) of Central Administrative Tribunal (Procedure) Rules, 1987 to file and maintain the Original Application jointly.
b) To direct the respondents to take into account the unfilled vacancies of 111 under EWS category and transfer them to the general category (UR) in connection with selection notification dated 15.07.2024 and thereafter amend and/or modify the result of the competitive examination 2024 dated 09.04.2025 from GDS to MTS and/or publish a supplementary result by doing the needful as prayed above.
c) To direct the respondents to take into account the chain vacancies created due to selection of MTS as PM/MG from eligible MTS candidates for the vacancy year 2024 (01.01.2024 to 31.12.2024) against the LDCE held on 25.08.2024 and DEST held on 06.01.2025 against Notification dated 15.07.2024 and include it in the vacancy year 2024 under selection notification dated 15.07.2024 and thereafter amend and/or modify the result of the competitive examination 2024 dated 09.04.2025 from GDS to MTS and/or publish a supplementary result by doing the needful as prayed above.
d) To direct the respondents to select and/or appoint the applicants as MTS if otherwise fit or eligible and/or coming within the zone of consideration in terms of their merit after completion of the exercised as prayed for at Para 8(b) and (c) above.
e) To direct the respondents to produce the entire record for selections of MTS from eligible GDSs in connection with Notification dated 15.07.2024 specially the records relating to number of chain/resultant vacancies arising out of selection of MTS as PM/MG for the vacancy year 2024 (01.01.2024 to 31.12.2024) against the LDCE held on 25.08.2024 and DEST held on 06.01.2025 against Notification dated 15.07.2024.
f) Any other order or orders as the Hon'ble Tribunal deems fit and proper."

4. M.A. No. 350/486/2025 for joint prosecution under Rule 4(5)(a) of the CAT (Procedure) Rules, 1987 is allowed. The applicants are allowed to pursue the remedy jointly, on payment of individual court fees (postal order/demand draft).
5. During the course of hearing, Ld. Counsel for the applicants has fairly submitted that it would suffice the purpose of the applicants if the Chief Post Master General, i.e., Respondent No. 2 would be directed to consider the representations of the applicants treating this O.A as a part of it and communicate his decision within a stipulated period of time and till then they should not be allowed to fill up the EWS vacancy as well as the chain/resultant vacancies arising out of promotion/selection of MTS/Postman/Mail Guard to the post of Postal Assistant/Sorting Assistant for the vacancy year 2024, as per the order dated 22.05.2025 passed by this Tribunal in O.A No. 720/2025.
6. Ld. Counsel for the respondents objects to the same.
7. In view of the above, Respondent No. 2 is directed to consider the representations of the applicants treating this O.A as a part of it and communicate his decision by way of a reasoned and speaking order within a period of 02 months from the date of receipt of a certified copy of this order and till then, not to take any action with regard to filling up of the EWS vacancies as well as the chain/resultant vacancies arising out of promotion/selection of MTS/Postman/Mail Guard to the post of Postal Assistant/Sorting Assistant for the vacancy year 2024 till the communication of the said order. It is made clear that we have not observed anything on the merit of the case.
