1. This is a Regular First Appeal filed by the Appellant [Defendant No.1 in CS(COMM) 104/2019] against the judgment dated 16.08.2024 [hereinafter referred to as „Impugned Judgment‟] passed by the Court of First Instance in CS(COMM) 104/2019 captioned M/s Cine Aryan vs. DTDC Express Limited and Others.
2. As per the report of the Registry, service of Notice upon the Respondent Nos.2 to 4 is still awaited.
3. From a perusal of the Impugned Judgment, it becomes evident that the Respondent Nos.2 to 4 were co-Defendants, in CS(COMM) 104/2019, with the Appellant.
4. The Court of First Instance has passed a decree for recovery of Rs.10,57,364/- along with interest @ 6% p.a. from the date of filing of the suit till realization, against the Appellant [Defendant No.1 in CS(COMM) 104/2019].
