1. This is a Reference dated 10.04.2015 sent by the Government of NCT of Delhi to this Tribunal with the following terms:-
"Whether the Taj Hotel Employees Association has locus standi to raise this Industrial Dispute and whether S/Shri Subhash Kant Jha and 36 Ors. (as given in Annexure A) are workmen as defined under I.D. Act, 1947 and if so, whether action of Management in retiring them at age of 55 years is illegal and / or unjustified; and if so, to what relief are they entitled and what directions are necessary in this regard?"2

2. Notice of reference was issued to the parties. The Claimant Poonam Kapoor appeared before the Court and filed her claim. The Management contested the claim by filing a written statement. Rejoinder to the written statement was filed by the Claimant controverting the pleas of the management and reiterating those of her claim.
3. Today i.e. on 14.12.022, Ld. Authorized Representative for Workman (ARW) appeared alongwith Claimant Poonam Kapoor in person and submitted that the Claimant wants to withdraw her claim.
64. Statement of the Claimant was recorded on a separate sheet in this regard.
5. I have heard Ld. Authorized Representatives for the parties and have also gone through the record.
6. In view of statement of Claimant Poonam Kapoor recorded today i.e. on 14.12.2022, her claim is dismissed as withdrawn. The reference in respect of Claimant Poonam Kapoor is answered accordingly.
7. Copy of the award be sent to GNCT of Delhi for publication.
8. No order as to costs.
9. File be consigned to record room.
