                                   ORDER

Per B.R. Baskaran (AM) :-

The assessee has moved this Stay Application seeking stay of outstanding demand.

2. At the time of hearing learned Counsel appearing for the assessee submitted that the Assessing Officer has already passed a Stay order on 15.2.2018 granting stay to the assessee upon payment of 20% of the outstanding demand. He submitted that the assessee has already paid 20% of the outstanding demand on 15.3.2018. Accordingly, the learned AR prayed that this appeal may be heard at an early date.

3. We heard learned DR and perused the record. Having regard to the submissions made by Ld A.R, we reject the stay sought by the assessee, since stay has already been granted by the Assessing Officer. Since both the parties agree for early hearing of the appeal, we are of the view that the appeal of the assessee may be heard early, on out of turn basis. Accordingly, we direct the 2 A c ce n tu r e S ol u ti o n s P v t. L td.

Registry to post this appeal for final hearing on 5.7.2018. Since, the date of hearing is announced in the Open Court in presence of both the parties, the Registry may desist from issuing formal notice of hearing to the parties.

4. In the result, Stay Application filed by the assessee is rejected.

Order has been pronounced in the Court on 16.3.2018.
