JUSTICE MUNISHWAR NATH BHANDARI Order 08/03/2019 It is stated that payment of gratuity has now been made to the petitioners, however, the basis of the calculation has not been disclosed. It is also stated that one month's salary has not been given to the petitioners thus further directions for its payment may be given.
Learned counsel for respondent-management committee submits that whatever amount was calculated and given by the State Government, has been paid to the petitioners.
It is towards gratuity and other payments. In view of above, nothing remains in these review petitions.
I have considered the submissions of the parties and find that petitioners were extended benefits pursuant to the order of the Tribunal other than the payment of gratuity. A direction for it was given and, now, amount of gratuity has also been paid. If any dispute about calculation of the amount remains or any payment arising out of the order passed by the Tribunal is due, petitioners are given liberty to file execution petition/s before the (11 of 11) [CRW-51/2018] civil court as the issue of calculation of the amount cannot be determined in these review petitions.
With the aforesaid, all the review petitions are disposed of.
