Heard learned counsel for the petitioner.

The petitioner has come up against the show cause notice dated 10th of December, 2009 whereby he has been given an opportunity of personal hearing.

Learned counsel for the petitioner has raised only one point that the petitioner has not been given the documents to file objections and this cause would be prejudiced.

The aforesaid apprehension is absolutely misplaced and is ingenuity of the petitioner. There is no apprehension under the show cause notice for not allowing the petitioner to submit his objections to the Inquiry Officer's report. The petition is misconceived and is dismissed.

Leared counsel contends that charges levelled are not proved while the Inquiry Officer has found the petitioner to be guilty. This is also a subject matter of consideration by the Disciplinary Authority and need not be gone into at this stage.

Dismissed.
