The present appeals arise from a common order dated 29.05.2014 allowing a batch of writ applications led by [15] DBSAW NO.1090/2015 & other connected appeals S.B. Civil Writ Petition No.6031/2014 (Dr. Bhanwar Lal Jat Vs. State of Rajasthan and others).

The appellants first preferred review applications against the common order. It was barred by 116 to 172 days delay. The review applications came to be dismissed on 03.04.2015 holding that the appellants could not in the guise of review applications seek a re-hearing of the case in absence of any error apparent on the face of the record. The present appeals have then been filed against the main order nearly seven months after dismissal of the review again barred by delay. The explanation for the latter delay is that time was consumed in examining matters at the level of the State Government and the Standing Committee.

The limited challenge laid out in the appeal is to the directions contained at item 3 and 4 in the penultimate paragraph of the order dated 29.05.2014.

Those directions are based on the UGC guidelines noticed in detail, the language of which is explicit and admits of no ambiguity. The appeals are not raising any substantial question of law having wider implications.

The explanation for the delay does not constitute sufficient cause and is very casual in nature. Not only was there a delay in filing of the review applications but also in [16] DBSAW NO.1090/2015 & other connected appeals preferring the appeals. Though some amount of latitude may be permissible to the State with regard to delay in filing appeals or review applications, it cannot be considered as a matter of right at every stage of the litigation to claim preferential treatment by urging what is merely pushing of the files from one table to the other as justification. If procedures take time, it is the bounden duty of the appellants that in such matters they display the alertness and alacrity so required.

The applications for condoning delay are rejected. Consequently, the appeals fail.
