                                                    ORDER

The writ petition has been filed by the petitioner association for the issuance of a writ of mandamus, directing the first respondent herein to pass orders on the petitioner's representation dated 13.10.2020 seeking to implement the recommendations of the Mitra Committee on HR Policy for Regional Rural Banks post CBS' constituted by the Government of India, as per the Circular No.35/1DD-02/2014-2015 dated 24.02.2015 issued by the second respondent and to initiate the process of staff recruitment and promotion in accordance with the recommendations within a time frame to be fixed by this Court.

2. The petitioner is a registered body representing employees of the respondent Regional Rural Bank. After adopting the Core Banking Solutions (CBS) for hassle-free services to rural clients, the committee on Regional Rural Banks have been constituted in the year 2009 to examine the issue of providing hassle-free services to the rural clients. Subsequently, NABARD had issued a circular dated 24.02.2015 to the Chairman of all Regional Rural Banks directing them to place the recommendations of committee on HR Policy for Regional Rural Banks for CBS implementation before their respective Boards for adoption with or without modifications. One of the recommendations made by the committee was to improve the strength of staff in the banks. Despite of https://www.mhc.tn.gov.in/judis 2/6 W.P. No.24391 of 2021 many vacancies, the same have not been filled up so far. Hence, the writ petition has been filed seeking a direction to the first respondent to fill the vacancies through direct recruitment and to fill up the promotional post.

3. Mrs.Rita Chandrasekaran, learned counsel for the first respondent submitted that the writ petition itself is not maintainable because the association has taken the cause of an individual and no promotion can be claimed as a matter of right.

Even though the circular issued by the NABARD will bind upon the banks, it is the individual who has to give representation to the appropriate authority to consider his career prospectus in accordance with the existing rules and regulations. In fact, the NABARD itself has addressed the first respondent to initiate the internal promotion process in order to fill up the vacancies. It is learnt that the first respondent is also taking such steps and it is in the process.

The individual has not taken up the cause for promotion. Further, the promotion cannot be claimed as a matter of right and also considering the fact that the first respondent has initiated the process in accordance with the circular issued by the NABARD, the members of the petitioners' union has to wait to see the light of the day.

5. With these observations, the writ petition stands disposed of. There will be no order as to costs.
