MA No. 682/2019 has been filed by the applicants for joining together in one application. For the reasons stated therein, the same is allowed.13 OA No. 588/2019
2. In the present OA, the applicants have sought the following relief:-
(i) Call for the records of the case.
(ii) Direct the respondents to grant the applicant Revised Pay Scale of Rs. 30,900 - 39100/- with the existing grade pay of Rs. 7600/- w.e.f. 01.01.2006, thus maintaining the same ratio between S-21 and S-24 officers for more thatn three decades.
(iii) Direct the respondents to consequently revise their pension/family pension in accordance with the (ii) above.
3. This OA has been filed jointly by 57 applicants, who have all retired and have been drawing pensionary benefits as per the Central Civil Service (CCS) (Pension) Rules, 1972. All of them are in the age group of 64 to 83 years and retired many years back. These applicants have been holding the S-21 pay scale in PB-3.
4. It is stated in the OA that after the recommendation of the 6th CPC, the respondents accepted the demand of their counterparts in Armed Forces and placed them in S-24 grade in PB-4. However, the civilian counterparts, i.e., the applicants were not extended the same benefit. It is stated that this parity was maintained prior to 6th CPC for over three decades. 14 OA No. 588/2019
5. The applicants have also compared their pay scales and grade pay with similarly placed counterparts. Despite representations made by the applicants, for parity in pay scales, on various dates from 17.10.2017 to 30.11.2018, there has been no response from the respondents.
6. It is also submitted that all the applicants belong to scientific and technical cadres and their grievances are pertaining to the pay scales fixed for them after 6th Pay Commission, vis-a-vis other services, specially, Armed Forces.
7. The applicants have stated that the representation made by them to the Respondent No. 1 dated 17.10.2017 has not been responded to. Follow up representation dated 30.11.2018 to the Respondent No. 1, has also been preferred and the same has not yet been acknowledged. Thus, aggrieved by no response from the respondents, the applicants have approached the Hon'ble Tribunal.
8. Learned counsel for the applicants reiterated the facts that the applicants are working in organizations of national importance such as DRDO and DAE. The recommendation of the 6th CPC have been modified to S-24 grade for the similarly placed in Defence Services, but the same has been denied to S- 15 OA No. 588/2019 21 grade Civilian Officers, who also served under the same Ministry of Defence and other organizations.
9. It has also been submitted that although the present application has been filed on 14.02.2019, for the perceived anomaly pertaining to year 2006, the same is not barred by limitation as getting lesser pay or pension leads to continuous cause of action.

Learned counsels for respondents opposed the plea of the applicants and stated that the applicants should have sought redressal of their grievances through Anomaly Committee, after the 6th Pay Commission. They have instead preferred this OA after over a decade and therefore the same is barred by not only limitation, but the same cannot be addressed now after the 7th Pay Commission recommendations have also been implemented.
11. Heard the learned counsels of the applicants and the respondents and perused the records, at the admission stage itself.

It is evident that the applicants have filed this OA aggrieved by the decision of the Government on the recommendation of the 6th CPC, way back in 2006 and have 16 OA No. 588/2019 approached the Tribunal after a lapse of about 11 years. There exists a special mechanism for redressal of the grievances after every pay commission, specially through Anomaly Committee.
13. The applicants have not taken up this matter with the Anomaly Committee or with the concerned departments and have submitted representation only in the year 2017 seeking relief in terms of getting their pay scales revised w.e.f. 01.01.2006 and re-fixation of their pay.
14. The respondents have strongly argued that any such relief to the applicants, specially after the 7th Pay Commission can not be considered at this stage, as it may involve far reaching ramifications. Similar grievances have been addressed at the appropriate time, immediately after the 6th CPC.
15. We are also of the view that the applicants have failed to take up the matter and address their grievances to the Anomaly Committee in time after the 6th CPC. Such objections cannot be adjudicated at this later stage.
16. In view of the above mentioned, we are of the view that the present OA is entirely devoid of merit and the same is dismissed at the admission stage itself. The applicants are at 17 OA No. 588/2019 liberty to address their grievances to the concerned authorities. There shall be no order as to costs.
