01. 1. Heard Mr. A.C. Behera, learned counsel for the petitioner and Mr. D.K. Mohanty, learned Additional Standing Counsel.

According to Mr. Behera, the plot bearing Nos.59 and 68/546 of the petitioner covering an area of Ac. 3.01 decimal pertaining to holding No.31 of mouza-Bhainsa in the district of Bolangir have remained waterlogged since long on account of construction of Khajurikaa Medium Irrigation Project by the Government and no steps are being taken either to get the water released from the plots or to pay him compensation. He further submits that though highlighting all his grievances, the petitioner has approached the Collector, Bolangir by sending a representation dated 30.06.2022 under Annexure-5 through registered post however, till date nothing has been done to redress his grievances. In such background, he prays that that a direction be issued to the Collector, Bolangir to take a decision on the above noted representation of the petitioner within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the Collector, Bolangir to take a decision on the above noted representation of the petitioner under Annexure-5 in accordance with law within a period of three months from the date of receipt of certified copy of this order, if in the meantime, the same has not been disposed of and communicate the result of such exercise to the petitioner.

4. Accordingly, this writ petition is disposed of.

5. Urgent certified copy of this order be granted on proper application in course of the day.
