ORDER:
This writ petition is filed challenging the award dated 06.09.2001, passed by the Industrial Tribunal-cum- Labour Court, Visakhapatnam, in I.D.No.24 of 2000.
Heard Sri S.V. Ramana, learned Standing Counsel for the petitioner Corporation, learned Government Pleader for Labour and learned counsel for the 2nd respondent.
It has been contended by the learned Standing Counsel for the petitioner-Corporation that the 2nd respondent-workman was initially engaged as Conductor and he was un-authorisedly absented himself and the petitioner-Corporation after conducting the detailed enquiry and proven misconduct, has imposed the punishment of removal of service on 4.5.1994 and thereafter, the 2nd respondent-workman, has filed the I.D.No.24 of 2000, before the 1st respondent-Tribunal and the 1st respondent-Tribunal had allowed the said I.D by an award dated 6.9.2001, preferred by the 2nd respondent-workman without appreciating any of the contentions raised by the petitioner-Corporation. Therefore, the learned Standing Counsel for the petitioner-Corporation contended that the writ petition be allowed by setting aside the impugned award passed by the 1st respondent-Tribunal.
Learned Counsel for the 2nd respondent-workman had contended that the 1st respondent-Tribunal, has rightly passed the impugned award in favour of the 2nd respondent-workman and no illegality or irregularity has been committed by the 1st respondent- Tribunal and prays to dismiss the writ petition. 2
Having considered the rival submissions of both parties, this Court is of the considered view that the 1st respondent-Tribunal has rightly passed the award in favour of the 2nd respondent- workman and no illegality or irregularity has been pointed out by the petitioner-Corporation. In the absence of the same, this Court cannot interfere with the award passed by the 1st respondent- Tribunal and there are no merits in the present writ petition.
Accordingly, the writ petition is dismissed. No order as to costs.
As a sequel to disposal of the writ petition, Miscellaneous Petitions, if any pending, shall also stand closed.
