1. The applications under Section 151 read with Principles Analogous to Order VI Rule 17 CPC have been filed on behalf of the petitioner to take an additional ground of challenge by claiming that the appointment of the learned Sole Arbitrator was unilateral. Since it is a legal argument which goes to the root and validity of the arbitration proceedings itself, petitioner is at liberty to agitate the same at the time of arguments.
2. Learned Senior Counsel appearing on behalf of the respondent submits that this amendment applications are barred by time and this is not a case of unilateral appointment.
3. Submissions heard.
4. Considering that the petitioner is only seeking to plead an additional ground of unilateral application of unilateral application of the Arbitration in this Petition under Section 34 Act and it is only a legal objection which can be taken at any stage, the petitioner is permitted to take his objection at the time of arguments.
5. Insofar as, the objections taken on behalf of the respondent is concerned, the same can be considered at the time of arguments on this ground under Section 34 of the Arbitration and Conciliation Act, 1996.
6. The applications are disposed of.
