The petitioner is seeking anticipatory bail in FIR No. 0128 dated 13.09.2021, under Sections 406 and 420 of the Indian Penal Code, 1860, registered at Police Station Sector 31, Chandigarh.
Learned counsel for the petitioner contends that it is alleged that 20 tons of linear low density polythene had been received by the petitioner, but he did not make the payment of `17,32,240/- to the complainant. He, however, contends that the petitioner had placed an order for purchase of polythene with M/s Vikram Enterprises with whom he has a running account and there is no dispute between the petitioner and M/s Vikram Enterprises. He further contends that the petitioner and the complainant are having business transactions over several years and due to monetary dispute, the instant FIR has been lodged. The petitioner does not have criminal antecedents. He also contends that the matter has been settled before the Mediation and Conciliation Centre of this Court.

The Mediator has sent his report along with the terms of the settlement dated 05.10.2021 which are taken on record.
Learned counsel has put in appearance on behalf of the complainant and states that the matter has indeed been compromised.
Heard.
In view of the above especially when the matter has been compromised, I deem it a fit case to grant the concession of anticipatory bail to the petitioner.
Therefore, the petitioner is directed to appear before the investigating officer within a period of 15 days from the date of receipt of certified copy of this order and on his doing so, he shall be released on bail to the satisfaction of the arresting/investigating officer till submission of report under Section 173 of the Code of Criminal Procedure, 1973 ('Cr.P.C.' - for short). The petitioner shall continue to join investigation and shall furnish an undertaking that he shall abide by the conditions as envisaged under Section 438 (2) Cr.P.C. Thereafter, he will be permitted to furnish regular bail bonds to the satisfaction of the trial Court.
The petition stands disposed of in the aforementioned terms.
