These are the appeals challenging the correctness and legality of the judgments and orders passed by the learned District Consumer Disputes Redressal Commission, Nanded ( the 'District Commission' for short) in various Consumer Complaints as indicated in the title clause of the judgment. Since the facts and issues involved in all these appeals are identical and the parties too are similar, we are disposing of them by way of this common judgment.

2. All these appeal are pertaining to Weather Based Crop Insurance Scheme, 2015-16 (the 'WBCIS' for short). The appellant in all cases is Agriculture Insurance Company of India Ltd, ('Insurance Company' for short), which was 'original opponent no.1', whereas respondent no.1 were the 'original complainants' and respondent no.2, which are the banks of the complainants, were 'original opponent no.2'. We are convenentely referring them all as to their 'original status' as parties, before the District Commission.

3. As per WBCIS the complainants in Agriculture Season 2015-2016 took the crop insurance for their 'banana' crops from opponent no.1 through their respective banks, which are opponent no.2. Under the scheme taking of crop insurance for the 'loanee' farmers was mandatory. As all the complainants were the loanee farmers they were mandatorily required to take the crop insurance through opponent no.2. The particulars of the name of the complainants, Consumer Case number, appeal number, size of insured land, are given in the following table.

4. Under WBCIS, 2015-2016 different weather triggers /insured events for the insured crop in insured unit have been notified by the Government. Those triggers / insured events are as follows.

1) Low Temperature :

If in the insured unit from 01.12.2015 to 29.02.2016 the temperature is recorded below 8 degree celcius for 3 consecutive days, the insured farmer would be entitle for the compensation of Rs. 25,000/- per hector.

2) High Temperature :

A) If in the insured unit from 01.03.2016 to 31.05.2016, in the month of March, for 3 consecutive days, the temperature is above 40.50 degree celcius, or in the month of April and May the same is recorded above 44 degree celcius, for same number of consecutive days, the insured farmer would be entitle to get a compensation of Rs. 10,000/-.

B) If in the insured unit during the same period mentioned above, in the month of March, in the insured unit the temperature is recorded above 40.5 degree celcius for 4 consucutive days, or in April and May above 44 degree celcius, for same number of consecutive days, the compensation payable would be Rs.15,000/-.

C) If in the insured unit during the same period as above, in the month of March, the temperature is recorded more than 40.5 degree celcius for 5 consecutive days , or in April and May above 44 degree celcius, for same number of consecutive days, the compensation payable would be Rs.25,000/-.

3) High Wind Flow:

If in the insured unit from 1.3.2016 to 31.7.2016 the wind flow for any of the days is above 40 km/hour the insured farmer will receive compensation maximum (caping) up to Rs.50,000/-. So as to claim the above compensation the first condition was that, there shall be entry of such high wind flow in the Automatic Weather Station ('AWS' for short) and the second condition was that, the insured farmer must intimate the said fact to opponent no.1 within 48 hours. On the intimation, panchanama would be prepared and on the basis of the same, compensation commensurate to actual damage, subject to the caping level of Rs.50,000/-, would be payable.

5. It was the case of the complainants before the District Commission that, since they were the loanee farmers, were required to take the crop insurance mandatorily for their 'banana' crops for the Agriculture Season 2015-2016. The insurance cover was given by opponent no.1 from 1.12.2015 to 31.7.2016. The cover was available as against the low and high temperatures, high speed wind, hailstorm. So as to measure the temperature as well as the high speed wind, opponent no.1 was to install AWS. Opponent no.1 installed it but not followed the norms of its installation. It was installed merely at 5 to 6 meters height from the ground level, when as per norms it was to be installed atleast at 10 meters height. It is found to be installed on the tereace of one house. As a result of it, AWS unable to record the accurate temperatures and high speed wind. During the period of 01.12.2015 to 29.2.2016 the temperature remained less than 8 degree celcius for 3 consecutive days and in the period 1.3.2016 to 31.5.2016 the temperature remained more than 40.5 degree celcius for 3 consecutive days, in May 2016 the temperatutre recorded above 44 degree celcius, but these temperatures were not properly recorded by AWS. Similarly, during the period of 1.3.2016 to 31.7.2016 the wind flow was above 40 km/hour but the same was also not properly recorded by AWS. During the period of 1.1.2016 to 30.4.2016 there had been hailstorms on many occasions, but there is no record of the same in AWS. With regard to the damage due to high speed wind and hailstorms the complainants informed them to Circle and Agriculture Officer. Though, the above all insured events happened in the insured unit of the complainants, opponent no.1 not granted them the agreed compensation as per scheme. It is therefore, they filed above referred Consumer Complaints before the District Commissions, in which the impugned judgments have been passed.

6. Opponent no.1 contested the claim of the complainants by filing its written version before the District Commission. It is contended by them that, none of the insured event has been recorded in AWS and therefore, the complainants are not entitle to get any insurance claim under the scheme. The compensation payable under the scheme was strictly in accordance with the data of low and high temperatures and that too, for 3, 77 FA/890 to1049/2019 4 or 5 consecutive days, as the case may be. There is no record in AWS which shows that, during the relevant period the temperatures were below 8 degree celcius and above 40.50 and 44 degree celcius. With regard to the high speed wind and hailstrom the scheme provides that, the insured farmer to intimate the incident within 48 hours of the occurance, so that a panchanama of the farm of individual farmer could be prepared and compensation as per the actual damage can be paid, subject to the caping amount. The complainants have not given such intimation. Hence, they are not entitled to claim any compensation under the scheme. The complainants have unnecessarily filed the Consumer Complaints and there is no deficiency in service caused to them.

7. Opponent no. 2 also appeared before the District Commission and resisted the claim of the complainants on the ground that, they played no role in assessing the loss and fixing the quantum of the compensation to the complainants. Their role is just to collect the appropriate premium and after the passing of the claim by opponent no.1, disburse that amount to the complainants. They have played that role accordingly. There is no deficiency in service caused to the complainants from them.

8. The District Commission after going through the guidelines of WBCIS and on evaluating the evidence produced before it by both the parties held that, there is deficiency in service to the complainants by opponent no.1. The District Commission observed that, AWS was required to record the triggers /insured events has been installed on the slab of one house. The photographs produced by the complainants establishes that fact. The certificate of the Engineer also proved it. The AWS has not been installed as per norms of the IMD, though it was obligatory in the scheme. The 'star question' was asked in the State Legislature of Maharashtra about such installation and the inquiry was lodged. The report of the same shows that the AWS has not been kept properly functional. Because of such faulty AWS the triggers /insured events have not been recorded. The District Commission even after that finding, relied upon the data of National Collateral Management System Ltd,. ('NCMSL' for short), which has been appointed (as per scheme) by opponent no.1. Therein, on 25.3.2016, 78 FA/890 to1049/2019 26.3.2016, 27.3.2016 temperatures of 40.1, 41.30, 40.70 degree celcius respectively have been recorded. The average /mean of these figures comes to be 40.7 degree celcius, which is higher than the 'trigger temperature' of 40.50 degree celcius. Therefore, the District Commission held the complainants to be entitle to a compensation of Rs.9,450/- per hector on account of high temperature. The District Commission also observed that, as per NCMSL data during the priod of 1 March, 2016 to 31 July, 2016 and more particularly on 5.5.2016 the speed of the wind was recorded at 40.3 km/hr. It is therefore, the complainants are also entitle to a compensation of Rs.47,250/- her hector. According to the District Commission, since the data of AWS regarding the high speed wind is within the knowledge of opponent no.1 only, and the same is not published by opponent no.1, it is not possible for the complainants to know that, whether the trigger has been hit or not and thereupon intimate it to opponent no.1. The District Commission, however not found the claims of the complainants as to the hailstorms to be acceptable during the period of 1 January, 2016 to 30 April, 2016 in any of the Revenue Circle including Limbgaon (insured unit of the complainants). There is no evidence produced by the complainants regarding the same beore it. Therefore, the District Commission granted compensation of Rs.47,250/- for high speed wind plus Rs.9,450/- for high temperature totalling Rs.56,700/- per hector to each of the complainants. The District Commission also granted Rs.2,000/- for mental and physical harassment and Rs.1,000/- as the cost of the proceedings to each of the complainants. It is against this order opponent no.1 filed the above mentioned appeals.

9. We heard all learned counsels Adv.A.G.Vasmatkar for the complainants, Adv.Mahesh Taur for complainants in certain cases as indicated in the title clause. Adv.M.R. Deshmukh for opponent no.1 in all cases. Adv. Nitin Wangikar for opponent no.2 (Maharashtra Gamin Bank). Adv.U.N.Shete for opponent no.2 (Union Bank of India).

10. Adv.Deshmukh for opponent no.1 faulted the impugned judgments and argued that all these appeals are based on the provisions of Governement Resolution dated 3.12.2015 of Governement of Maharashtra 79 FA/890 to1049/2019 and Modified National Agricultural Insurance Scheme. As per the scheme opponent no.2 was under a duty to collect premiums from every participating farmer and sent that data to opponent no.1. Though there were several communications made to opponent no.2 to provide the insurance details of farmers, no response was given. He reiterated the stipulations as to WBCIS about the triggers / insured events as has been discussed in para no.4 of this judgment and argued that none of the insured events has happened in the insured unit of the complainants. The District Commission ignored these vitle fact. It is his further argument that, the District Commission committed an error in imposing the liability for the trigger of high temperature in the month of March. While imposing said liability a methodology adopted by the District Commission is not prescribed in the scheme. The scheme provided that, for 3 consecutive days the temperature should have been above 40.50 degree celcius. The District Commission choose the 3 dates from the data and applied formula of drawing 'mean temperature' of those days, which is 40.70 degree celcius. The scheme is based on the agreement entered into by State Government with opponent no.1. The settled principle of law says that, the terms of contract are to be read and interpreted qua-contract.

11. In relation to the high speed wind, it is his submission that, the Government Resolution dated 22.1.2016 provided the detailed procedure to be adopted for conducting panchanama. As per that Resolution merely because there is an entry of high wind flow recorded at AWS, the insured does not become eligible to an insurance claim. He has to intimate it within 48 hours to opponent no.1 in writing for conducting panchanma for assessment of actual loss.

12. Thus, on the strength of the above submissions, it is argued by Adv.Deshmukh for opponent no.1 that, the District Commission grossly ignored all these important facts and fell into error in holding opponent no.1 liable in a manner referred to above. He relied on the following judgments to demonstrate that the stipulations / guidelines of WBCIS shall be interpreted in letters and spirit, in strict manner and the divergence from them is not permissible.

2) Libaraj Tulshiram Tikle Vs. State of Maharashra and others W.P.No. 1668/2005, decided on 15.01.2015 by Hon'ble High Court of Bombay, Bench at Aurangabad.

3) Agriculture Insurance Company of India Ltd,. Vs. Badri Singh Bisth and another, RP No. 1654/2016, Hon'ble NCDRC decided on 24.10.2016.

4) Ajit Singh Malubhai Ghummad Vs. Union of India Civil Appeal No.6040-6041/2011 decided by Hon'ble Supreme Court, on 11.8.2021.

8) Vividh Karyakari Seva Sahakari Society Ltd,. Vs. Union of India and Others W.P.No. 2353/2003 Hon'ble High Court of Bombay, Bench at Aurangabad, decided on 1.2.2017.

13. Adv. Vasmatkar for the complainants countered the above submissions. It is his argument that, there is no error committed by the District Commission in the impugned judgments to held that, the triggers/insured events as to high temperatures and that of high speed 81 FA/890 to1049/2019 wind gets operated on the given dates, eventhough not on all 3 consecutive days, but on average/mean basis. The divergence of District commission from the stipulations or guidelines of the scheme in the impugned judgment is totally justified on account of the faulty AWS. As per the guidelines of the scheme, the AWS shall be installed in accordance with the norms given by the Indian Meteorology Department (IMD), which says that, the tower of AWS shall be at the height of 10 meters from ground level. There shall not be trees or any building greater in height than that of the AWS tower. The sensors shall be properly installed and shall sustain in all weather conditions. The design of the AWS shall be such that, it shall record the relevant data in truely representative manner, within the radius of 25 km of such tower etc. Opponent no.1 not ensured these, IMD guidelines at the time of installation of AWS. The evidence of the improper installation of AWS has been given by the complainants before the District Commission. The same has rightly been relied upon by it. There is no error in the impugned judgments and it does not requires any interference. According to him all the triggers as to low and high temperature, high speed wind and hailstorm have been operated. But the District Commission not considered the triggers as to 'low' temperature and 'hailstorm'. The District Commission ought to have granted the caping insurance amount of Rs.1,33,000/- for all the triggers as per scheme.

14. It is also pointed out by Adv. Vasamatkar that, the rulings cited and relied upon by opponent no.1 cannot be applied to the present cases, as the facts in those rulings are different, especially when in none of those rulings there was the issue of faulty AWS as it is there in the present matters. In the present cases, all the complainants have raised that issue before the District Commission. Infact the entire complaint of the complainants is based on the said issue alone. This issue has also been raised by the insured farmers including the complainants through their elected representative of the State Legislature in the Maharashtra State Assembly. The assembly directed an enquiry into the matter. In that enquiry, it was found that, the AWS have not ben installed as per the norms/guidelines of the IMD and were faulty in nature. Adv.Mahesh Taur 82 FA/890 to1049/2019 for the complainants in certain cases as mentioned above re-iterated the above arguments and submissions of Adv. A.G.Vasmatkar.

15. Thus, it can be seen from the above submissions that, the main issue in all cases is as to the imperfectness and faulty installation of AWS. The divergence of the District Commission from the guidelines or stipulations of the WBCIS and that of non intimation of high speed wind within 48 hours is the secondary issue. It cannot be denied that, the formulation of WBCIS is vitally based on the collection of weather data by AWS. The imperfection in it will not only affect rights and liabilities of the insured farmers, but also of opponent no.1. Suppose take an adverse case that, due to imperfect installation of AWS, all the triggers shown to have been operated, in that event whether opponent no.1, without questioning would have granted the insurance claims to the complainants. We do not think that, it would have honoured the claims of the complainants. The IMD guidelines are impartial in nature and are there to ensure justice to both sides of the fulcrum. It is for the same reason IMD guidelines were required to be followed by the implementing agencies and more particularly very cautiously by opponent no.1. We are unable to convince ourselves by the submission of Adv. Deshmukh for opponent no. 1 that, opponent no.1 has no role to play in installation of AWS and its accuracy has to be ensured by co-ordination committee.

16. So I to understand the importance of accuracy of the recording of the weather data by AWS, we need to refer to the relevant IMD guideline No.2 which are as follows...

2.1.2: Exposure Conditions for Sensors.

2.1.2.1 : Wind speed and directions:

2.1.2.1.1: The wind speed and directions sensors are required to be installed on a mast at the height of 10 meters from ground level.

2.1.2.1.2: The sensors are required to be located on the mast, which is installed at a distance of at least ten times the height of nearby 83 FA/890 to1049/2019 building, trees or other obstructions.

2.1.2.2: Air Temperature and Relative Humidity :

2.1.2.2.1: The Standard Measurement Height for air temperature and relative humidity sensor is 2 meters.

2.1.2.2.2 : The sensor is to be located at a distance of at least two times the height of obstruction like trees, building etc. 2.1.2.2.3 : Large paved areas, bitumen surfaces in the vicinity of at least 30 meters have to be avoided.

2.1.2.3. Rain fall :

2.1.2.3.1. : The rail fall sensor is placed in an open area at a minimum distance of two times the height of any obstruction.

2.1.2.3.2. : The standard measurement height is 30 centimeters above ground level.

2.1.2.3.3. : In places where flooding is more, the height may be 1 meter from the ground level.

17. The perusal of these guidelines makes it crystal clear that, the AWS in the present case is totally contrary to the IMD guideline. Further as per guidelines AWS are not only to read the weather data accurately but also to communicate it in 'real time' to the server of opponent no. 1. It is therefore, as per WBCIS, the first person to know about the hitting of the triggers/insured events is opponent no.1. The insured farmers, including the complainants, very strangely, comes to know about it, only at the end of the agriculture season of the scheme, when they do not receive any claim amount despite of the fact that all triggers, according to them supposed and experienced to have been operated.

18. Further, it cannot be overlooked that, while framing the terms of WBCIS, the insured farmers, though are forced to take the part, as a loanee farmers are not consulted in fixing the same. They have no role to 84 FA/890 to1049/2019 play except to pay the requisite premiums to opponent no.1 through opponent no.2. The Consumer Protection Act, 1986 provides that, the consumer is having the right to know about the quality and accuracy of the service. In that sense, the terms of the scheme are likely to be lopsided in favour of opponent no.1. It is our considered view that, because of this fact the guidelines/terms of the WBCIS cannot be equated with the terms and conditions of other insurance policies/ contracts like life, health or fire insurance and may receive liberal interpretation instead of strict interpretation in view of benevolent scheme like WBCIS.

According to us, under these circumstances the District Commission has rightly balanced the fulcrum of the justice, when it is found to it that on the basis of the data of NCMSL (the third pary appointed in concurrence of opponent no.1) the triggers of high temperatures and high speed wind were recorded, though not on three consecutive days but on an average/mean basis in the relevant days. Here it cannot be forgotten that the banana crop, for which complainants had a taken crop insurance is hypersensitive to low and high temperatures and also to the speedy wind, as its stem is not as much firm as that of other crops. In these circumstances, when as per WBCIS, the first person to know about all the adverse weather conditions including the high speed wind with real time data is opponent no.1, the intimation of high speed wind by complainants does not assume much significance. It is true that, opponent no.l may not possibly know the 'actual damage' to individual insured farmer, but for implementing the benevolent scheme like WBCIS to protect the insured farmers, they can be reasonably and in the interest of justice, expected to set up their offices in each taluka, where their officers can call upon by way of public notification the insured farmers to get such intimation and prepare the panchanama in time accurately. It is the principle of justice that the person who seeks equity must do the equity first.

20. So far as the rulings relied upon by Adv. Deshmukh for opponent no.1 are concerned, in a none of those cases there was an issue raised by the insured farmers as to the imperfect/faulty installation of AWS and 85 FA/890 to1049/2019 because of that weather data was not recorded accurately, which is there in present cases. As such, in view of these distinguishing facts the ratio laid down by the Hon'ble Higher Courts in those cases cannot be applied to the present cases.

21. Here, we may conveniently refer to the decision of this Commission passed by our learned predecessor bench in Agriculture Insurance Company of India Ltd,. Vs. Subhash Bhosale and Others FA No.589 to 608/2017 decided on 04.05.2017 wherein, in the similar set of facts this State Commission upheld the similar findings of District Commission and held that the 'mean' temperature of 3 consecutive days can be considered to have operated the trigger of low temperature. That decision had been challenged before the Hon'ble National Commission in RP No.2832/2017, decided on 5.1.2018. The Hon'ble National Commission upheld that judgment of this Commission. We are also relying on that judgment.

22. The foregoing discussion makes it clear that, there is no error or legal infirmity in the impugned judgments. Therefore, we are of the view that, the District Commission has rightly granted the amount of compensation.

As such, the impugned judgments will have to be confirmed. Consequently, the appeals will have to be dismissed. In view of the facts of these appeals it will be just to direct opponent no.1 to pay to each of the complainants sum of Rs.5,000/- as the cost of this proceedings. Hence, we pass the following order.

ORDER

1. The impugned judgments are hereby confirmed.

2. The appeals are dismissed.

3.Opponent no.1 shall pay to each of the complainants sum of Rs.5,000/- as the costs of this proceedings.

4. Copy of this judgment shall be kept in FA/890/2019 and certified copy of the same shall be kept in all other appeals.

5. Copy of this judgment shall be furnished to the both sides free of costs.
