(Stay application No. 2496 of 2012) Learned counsel for the petitioner files amendment application no. 2620 of 2012. The same is taken on record.
Heard.
The amendment application is allowed. The petitioner shall file amended memo of writ petition during the course of the day.
Also heard on stay application.
According to the petitioner, she is also entitled for the old age pension under the old age pension scheme and that recovery citation has been issued for recovery against the petitioner for recovery (Annexure-5 to the writ petition).
The contention of the learned counsel for the petitioner is that the amount of pension, which has already been paid to the petitioner cannot be recovered. The matter requires scrutiny.
Till the next date of listing the amount under the recovery citation shall not be recovered from the petitioner.
(Stay application no.2496 of 2012 stands disposed of.) Learned Standing Counsel for the respondents prays for and is granted four weeks' time to file counter affidavit. The petitioner may file rejoinder affidavit in two weeks thereafter.
