The petitioners, apprehending arrest in connection with Chandipur Police Station Case No.149/16 dated 22.6.2016 under Section 341/323/325/379/448/354B/436/506/34 of the Indian Penal Code, have approached this Court for pre-arrest bail.
Heard the learned Advocate appearing on behalf of the parties. Perused the case diary.
The claim of the learned Counsel for the petitioners that the petitioners are standing on the same footing with the co-accused, who are on anticipatory bail granted by a Co-ordinate Bench of this Court on September 22, 2016 in connection with CRM No.6453 of 2016, has not been disputed by the learned Counsel for the State.
Having regard, we allow their prayer for anticipatory bail on parity.
In the event of arrest of the petitioners in connection with the aforesaid case, they shall be released on bail to the satisfaction of the Arresting Officer upon furnishing bond of Rs.5,000/- each on condition that after release, they shall surrender before the regular court within four weeks thereafter.
2This order is subject to the conditions as laid down in sub- Section (2) of Section 438 of the Code of Criminal Procedure.
The application for anticipatory bail is, thus, disposed of.
